Each year, an estimated 400,000 babies are born in the United States to mothers who are illegal immigrants. More than 25 percent of those babies are born in California.

Although Congress has never passed a law saying so, no president has ever ordered it, and no court has ever ruled on the issue, each of these babies automatically becomes a U.S. citizen when it takes its first breath.

That could change if legislation that Rep. Dan Lungren, R-Gold River, joined in sponsoring in April becomes law.

Lungren, who served as California’s attorney general from 1990 to 1998 and worked on the last successful push for an immigration overhaul when he represented Long Beach in the Congress in the 1980s, said he is trying to stimulate a debate on what he believes is a key factor drawing immigrants illegally across the U.S.-Mexico border.

Critics have another word for it.

“Xenophobia,” said Crystal Williams, deputy director of the American Immigration Lawyers Association. “They are afraid of having more Hispanic citizens.”

Contributing to the evolution of U.S. policy is the 14th Amendment to the Constitution. Ratified in 1868, after the Civil War, it was intended to ensure that children of freed slaves were extended U.S. citizenship. The amendment states simply that anyone born in the United States and “subject to the jurisdiction thereof,” is a citizen.

U.S. policy has come to recognize “birthright citizenship” in just about every vital transaction.

I think the illegal alien issue is out of control on more than one front. This is just another reason we HAVE to get control. If for no other reason but for the welfare of these children. Being born into an environment where they are raised among those involved in an illegal subculture just isn’t fair. They need to be back in their own country where their children aren’t put into untenable positions.

Illegal parents aren’t suitable parents. It’s unfortunate, but true.

Rolls-Royce prevails in patent litigation dispute against United Technologies Corp

On May 5, in an opinion handed down by Judge Rader for the Federal Circuit Court of Appeals, the Circuit court upheld the decision of the US District Court for the Eastern District of Virginia rendered by Judge Brinkema where the court held that United Technologies Corp.’s (UTC) patent only covered rear sweeping jet engine fan blade tips. The Court of Appeals held that because the district court correctly determined that Rolls-Royce, PLC’s (Rolls-Royce) forward sweeping blade tip patent would ‘not have been obvious’ in light of UTC’s application of their rear sweeping blade tip, the judgment of the District Court was proper. That decision can be found here.

The District Court’s prior ruling overturned a decision of the Board of Patent Appeals and Interferences (BPAI) in an interference proceeding which involved an improved design for jet engine fan blades that allowed for a reduction in the amount of shockwaves produced by the engine.  The BPAI’s prior ruling was in favor of UTC, holding that UTC’s patent application covered a fan blade that had a tip that swept either forward or rearward. 

By affirming the District Court’s decision and the overruling of BPAI’s determination, the Circuit Court of Appeals has effectively limited the ‘not obvious’ test for allowing new patent applications. Judge Brinkema’s decision utilized the ‘not obvious’ test and rejected UTC’s argument that a forward sweeping tip of the fan blade is an easily predictable and achievable variation in view of the disclosure of the rearward sweeping tip in UTC’s earlier application. The Court of Appeals affirmed the judgment that the forward sweeping blade tips were ‘not obvious’ because of the availability of a broad selection of choices for further investigation that included any degree of sweep for the fan blade tip. A further consideration secondary to the ‘not obvious’ test, was that an embodiment of Rolls-Royce’s invention had become the industry standard, thus the Court of Appeals reinforced the finding of non-obviousness. Barge Crashes into Philadelphia Duck Boat, 37 Over-Board, 2 Still Missing

Last Wednesday a Duck Boat tour boat was stranded on the Delaware River with engine problems. Passengers report that smoke was coming from somewhere on the boat and that they were waiting for help to arrive when a barge plowed into the much smaller Duck Boat. The Duck Boat, along with all 37 passengers, was overturned into the water as the barge ran into it. Rescuers were on the scene within 10 minutes to rescue 35 of the 37 passengers.

The United States Music Copyright Laws?

Question by NekoDoodle: The United States Music Copyright Laws?
So growing up and all I was under the impression that only one copy per purchase could be played at a time.
Example; You don’t play “bought once two copies” Sexy Sadie at location A and location B at the same time.

But, not sure anymore. Is it alright to download music if you can’t find it sung by that person anywhere else? Is it alright if you plan on buying it later? Is it alright if you have a (movie, game, tv-show ETC.) where that song is featured? Can you rip songs from a cd, and then give said CD to someone else?

Could someone explain the FBI-Anti piracy warning in /my/ language? As in make it understandable from average-person to average-person, not lawyer to average-person.

This is all hypothetical and I’m just confused.

The RIAA has a website dealing specifically with piracy questions. The website is obviously skewed towards the music industry, but it does a pretty job of explaining the complex laws in lay terms.

Aussie Comedy Film Nominated for United Nations Media Peace Prize

Sydney, Australia (PRWEB) September 12, 2004

An Australian comedy short film The Ball that recently screened on Australian TV Network Ten as part of the “Just for Laughs” comedy series has been nominated by the United Nations for a Media Peace prize.

The short stars veteran Australian actor Max Gillies (“Gillies Report”) as a cricket loving Prime Minister Howard and Australian comedienne Gabby Millgate (“Babe Pig in the City”, “Muriel’s Wedding”) as a soccer loving boat person who washes ashore in Australia. The nomination is reportedly the first time a short film, and additionally a comedy short film, has been nominated for the award.

The film is the brainchild of Anny Slater, a Melbourne raised Sydney entertainment lawyer who wrote and directed the film, and who with fellow producers Lily Hamdan and Serafina Froio, has steered the film to success at more that 60 international film festivals since its release in April 2003 including the short listing at the 2004 Oscars as best live action short film and screening at The Hamptons and San Francisco Film Festivals. At San Francisco, the film was a finalist for best short film selected by a panel headed by international director Milos Foreman (“Amadeus”). It also played at the Santa Fe Film Festival alongside such films as Nicole Kidman’s “The Human Stain” and at the Montreal Comedy “Just for Laughs” Festival with Carl Reiner’s film “The Man with Two Brains”.

The St Johns Film Festival, Canada said of the film “…a sign of artistic maturity is the ability to look at the world with razor-sharp wit…. The Ball is a hilarious homage to and critique of Jane Campion’s The Piano, …. In a few brilliantly crafted images, The Ball manages to score major laughs of recognition, as the mute heroine, Ada, travels to New Zealand to meet her new husband with her Scottish terrier and her soccer ball. Mistaking refugee-challenged Australian Prime Minister John Howard for her husband, Ada must deal with his strange demands and the loss of her precious ball. Need we say more?”

Ms Slater said, “The Ball is a kind of ‘natural response’ for me to the distressing Australian and international events of the last 2 years. Comedy is most often the most effective method of highlighting serious issues. I’m just glad it translates to audiences locally and in other countries so they can laugh today and think about the underlying issues tomorrow.”
