Houston Divorce Law Firm Explains: Uncontested and Contested Divorce

Choosing to divorce and separate from your spouse requires planning.  It also comes with emotional, religious, financial, and child-related issues.  Depending on your situation, and the agreement between you and your spouse, you can file a petition for a contested or uncontested divorce.

You can file for divorce in Texas if you or your spouse has resided in the state for six months or longer, or in the county for 90 days or longer.  If you are in the military and are stationed in Texas, you can assume the same residency requirement.

Is your divorce a mutual consent?  If it is, and you are in agreement as to children’s needs, and the division of assets and debt, then you can file an uncontested divorce claiming the marriage is insupportable with no hopes of reconciliation.  Additionally, if your spouse has abandoned you, you can file an uncontested divorce.

Are you disagreeing with your spouse?  Is your spouse at fault?  If you have answered yes to either of these questions, then you should file a contested divorce.  Family law lawyers in Houston can help you.  A contested divorce can have any of these grounds:

• Abandonment
• Adultery
• Domestic Abuse
• Incarceration
• Incurable insanity

Mediation or a separation agreement are ways to iron out differences you and your spouse may have concerning child-related issues such as custody, support, and visitation, and financial issues such as division of assets and debt.  An experienced divorce mediation attorney will sensitively redirect any emotions you both may feel into creating a plan for your future, especially that of your children.

Mediation is a cost-effective solution which saves time and keeps you out of court.

In any event, hiring an attorney for an uncontested and contested divorce, mediation, and separation agreement is a smart way to protect your interests and plan for your future.  Filing paperwork yourself can be frustrating, and may cost you more in the end in terms of settlement.

What kind of education do lawyers learn about? What types of lawyers are there?

Question by James Y: What kind of education do lawyers learn about? What types of lawyers are there?
And obviously, dont’ answer with “they learn about the law.”

I’m just wondering about the things lawyers do…ANYTHING at all about lawyers (including any emotional results you or someone you know experienced, because of being a lawyer).

In the past, and presently, being a lawyer always appealed to me, but I have no idea why, considering I know almost nothing about it.
Also, if there is a recommended level that lawyers should be at (by level I mean a bachalor’s degree, master’s degree, PhD, etc), how many years would it take to reach it?

You seem interested in a lot more than what you are asking, so if you like to do research, check out this site: http://www.abanet.org/legaled.html
It has links to different things that lawyers learn about, you can find out different types of law, and check out what you should be doing if you are interested in a career in law.

Lawyers have so many different things they do, that they learn different things. Something they all learn is how there are different interpretations of the law, and how to research, and how to make a point.

All law students in the US are required to have a Bachelors and generally require 3 years of law school.

Types of liability insurance

Types of liability insurance

When a company decides to buy liability insurance it is essential to consider the various factors that are required for taking a policy. A policy can be purchased depending upon the no of employees and the nature of risk involved. For instance, a company will be engaged in using heavy machineries to manufacture a particular product. In such cases, lots of precautions are taken so that the employee is not affected while using the machine but even then there are chances for bodily injuries to take place. The affected employee will file a lawsuit against the company as he was injured while working in the premises of the company. To cover the loss incurred when an employee is injured, the company can take employer liability insurance.

If your business is properly insured then you can concentrate on other major tasks and you can be at peace. Some liability insurance policies cover all the basic insurance needs but if your company needs a specific type of coverage then a D&O liability, employer liability or professional liability insurance policy can be purchased. Another type of liability insurance is product liability insurance. Any accident, minor injury or even death can be caused due to the product manufactured by your company. The amount of coverage that needs to be covered in the policy, which you buy, depends upon the type of product produced by you.

A hospital or a medical institute is a place for saving lives and it employs not only doctors, but also therapists, nurses, physician assistants. Sometimes few professionals will deviate from the standards set by the medical community, which will result in injuries to the patient. In such a case, professional liability insurance needs to be taken by the hospital for its employees. Certain countries have made it mandatory for doctors to have malpractice insurance policy. Lawyers or attorneys can be sued for breach of contract, negligence of duty, violation of good faith or improper advice. Financial loss can be covered up to a certain limit, provided the attorney is covered by professional liability insurance.

It’s not possible for a company to buy all types of liability insurance policies. Hence it is mandatory to find out who will be exposed to a greater level of risk and based on it the apt policy can be purchased. The company can also choose to opt for an occurrence or claims made policy. Occurrence policy is where the coverage includes claims that are made after the occurrence of the incident and policy expiration. In this case, if the incident has occurred during the policy period and a claim is made after months or even several years, the loss can be transferred to the insurance company. On the other hand, a claim made policy is wherein, the incident as well as the claim takes place during the policy active period.
