Temporary restraining order in Texas custody case?

Question by yougood: Temporary restraining order in Texas custody case?
I obtained a tro in Texas against my ex spouse on behalf of my child. In a nutshell it states that he can not disturb the peace of the child, withdrawl her from enrollment in school, or hide or secret her. It goes on to say ” The add’tl temporary injunction prayed for should be granted. Respondent should be denied access to the child or ordered supervised visitation.” My lawyer says that this should temporarily stop my ex from court ordered visitation where he picks the child up and drops the child off at the school for his weekends. However when the school districts lawyer reviewed this they state that it does not restrain him from visitation rights and the child can be dismissed from school into his care. Does anyone know what this TRO means? Am I screwed on this?

TRO stands for Temporary Restraining Order…

Call the judges office that issued the restraining order and explain to the court clerk that there is a mis-understanding in the wording of the order.. and that the school lawyer has intentions of releasing the child into his custody…

Ask for a clarification on the wording and a revised TRO or an amendment of clarification to the existing TRO… and that should clear it all up.

The school needs what ever court orders – in writing.. they can not accept your word that “this is what the court clerk told me”…

Sorry your having to go through this.. but it will all work out at some point in the near future…

I’ve heard many women say that a TRO is just a piece of paper that ain’t worth diddly squat and usually doesn’t stop much. It’s a shame. I remember a couple of women getting killed by their ex where I live, and those women had a TRO. : > ( . I hope that your ex isn’t violent towards you or your child because those types never give up until they hurt their ex lovers or ex spouses. Just stay on top of the police who are suppose to enforce the TRO. They can get very lazy sometimes.
