Q&A: Is it possible to get a non-disclosure agreement with a patent lawyer? If so, would the lawyer be willing to?

Question by Terry: Is it possible to get a non-disclosure agreement with a patent lawyer? If so, would the lawyer be willing to?
I have an idea that I want to patent and have considered seeing a patent lawyer. I do have concerns about this however. I have read questions before about a patent lawyer stealing your idea or giving your idea to a big company within the industry your idea falls into. Most people have said to mail whatever documentation you have about the idea to yourself via certified mail. I think this is a brilliant idea! HOWEVER, I am the type of person who likes redundancy. If I wanted to have a patent lawyer sign a non-disclosure agreement, would they be willing to do so? I truly believe my invention is worth billions of dollars and I don’t want some “lawyer” to steal my idea or give it to a potential competitor of mine. I really don’t think I would do business with a patent lawyer if they didn’t sign an NDA. An idea worth billions of dollars is not to be taken lightly.

Lawyers are bound by the Ethical Canons not to disclose ANYTHING that a client says to them without the client’s permission. Thus, whatever you tell the patent lawyer will stay with him/her.

S/he won’t have any problem whatsoever signing a NDA.

Rolls-Royce prevails in patent litigation dispute against United Technologies Corp

On May 5, in an opinion handed down by Judge Rader for the Federal Circuit Court of Appeals, the Circuit court upheld the decision of the US District Court for the Eastern District of Virginia rendered by Judge Brinkema where the court held that United Technologies Corp.’s (UTC) patent only covered rear sweeping jet engine fan blade tips. The Court of Appeals held that because the district court correctly determined that Rolls-Royce, PLC’s (Rolls-Royce) forward sweeping blade tip patent would ‘not have been obvious’ in light of UTC’s application of their rear sweeping blade tip, the judgment of the District Court was proper. That decision can be found here.

The District Court’s prior ruling overturned a decision of the Board of Patent Appeals and Interferences (BPAI) in an interference proceeding which involved an improved design for jet engine fan blades that allowed for a reduction in the amount of shockwaves produced by the engine.  The BPAI’s prior ruling was in favor of UTC, holding that UTC’s patent application covered a fan blade that had a tip that swept either forward or rearward. 

By affirming the District Court’s decision and the overruling of BPAI’s determination, the Circuit Court of Appeals has effectively limited the ‘not obvious’ test for allowing new patent applications. Judge Brinkema’s decision utilized the ‘not obvious’ test and rejected UTC’s argument that a forward sweeping tip of the fan blade is an easily predictable and achievable variation in view of the disclosure of the rearward sweeping tip in UTC’s earlier application. The Court of Appeals affirmed the judgment that the forward sweeping blade tips were ‘not obvious’ because of the availability of a broad selection of choices for further investigation that included any degree of sweep for the fan blade tip. A further consideration secondary to the ‘not obvious’ test, was that an embodiment of Rolls-Royce’s invention had become the industry standard, thus the Court of Appeals reinforced the finding of non-obviousness. Barge Crashes into Philadelphia Duck Boat, 37 Over-Board, 2 Still Missing

Choosing a patent or copyright lawyer can be difficult, especially if you are already having legal troubles that are causing lots of stress. If you follow these guidelines, though, you should be able to disregard the lawyers in your area that cannot give you the services and advice that you need so you can focus on those that are right for you.

Patent and Copyright Lawyers

You will probably have to talk to several patent and copyright lawyers before you find the one that you want to hire. Making the right decision is very important, so you want to take your research seriously. Taking it lightly could be a costly mistake.

First, you might want to ask the lawyers what types of law they practice. If you have never used the services of a lawyer or law firm before, them you might not know that attorneys focus on specific parts of the law. Some of them might be experts in tax law, family law, or drug law, but that does not mean that they can give you the patent and copyright services that you need.

Patent and Copyright Lawyers with Experience

When you contact the lawyers and firms in your area, you should ask them what types of law they practice. You might find that many of them cannot give you the services that you need. Others, however, should have an abundance of experience with copyright or patent law. Ask them how long they have offered their legal services to clients to help you get a better idea of how much experience they have. Those with the most experience should presumably know the law very well.

That is why it makes sense to ask them for references. Their other clients will know better than anyone if the lawyer is reliable, knowledgeable, and hard working. Talking to the lawyer’s other clients can be one of the best ways to find out if she or he is worth hiring.

Nor is it unheard of to be accused of a patent violation when there isn’t one. Either way, fast action is required if you or your company is accused of patent violations.


The first step is contacting a patent infringement lawyer, someone who can guide you step by step in protecting your assets, your company, and you reputation while an investigation is conducted into the patent violation accusation. As you follow your patent infringement lawyer’s advice, you may discover that you or your company is completely innocent, or you may discover that you accidentally violated patent infringement laws.


The laws protecting patents and those which outline patent violations are very intricate, and should be interpreted by a qualified patent infringement lawyer if there is any question of potential patent violation from concept to final production. Patent violations costs companies million of dollars and should not be taken lightly.
