Question by Info Sponge: How long is normal for a lawyer to respond to your question?
I am in a case based on contingency.
My original lawyer was fab and I slept well at night knowing that he was taking care of things.
He left the company and started his own firm.
The office seems overwhelmed since he left. I can go months without any correspondance, and all correspondance is based on me asking.
At first I gave them the benefit of the doubt and assumed the whole time that they were working on my case, but when I beg for an update I pretty much realize that nothing has happened.
I had to remind them five weeks ago that the statute of limitations was coming up. They filed for an extension.
I haven’t spoken to my “offical lawyer” for over a year. The three times I’ve asked for a conferance call, all-of-a-sudden my lawyer has been changed.
It’s too late and expensive to change firms at this point. It’s hard to get out of a contingency agreement (40%). They are actually a good firm but understaffed. They keep telling me that they can’t respond because they will be travelling for court.
Because of the time frame, I’ve had to take the bull by the horns and do my own research, hire my own para-legal, do my own asset search, research medical journals, secure witnesses, and so on.
I’m not interested in harrassing them, I’m only interested in settling my case as fast and as efficiently as possible.

Considering that we have only 9 weeks to file suit: The last email they sent me was three weeks ago. It was to say that they will be in trial on another case.
I’ve sent an email about every ten days asking to arrange a conferance call and asking if they have the lab results to send me. I’ve only been able to speak to them on the phone once in 12 months. It’s been three weeks since an email reply.
I’ve never been in a civil case before (hopefully will never have to again).
Is this normal or am I being too polite slash screwed?

Go to their office. Correspondence should be returned within 48 hours.

Deadly New York Fuel Truck Explosion Closes the Long Island Expressway and Draws the Attention of Personal Injury Lawyer, David Perecman

In an unfortunate accident spectacular enough to make the national news, a fuel truck flipped and exploded on New York’s Long Island Expressway. Approximately 200 feet of road melted in the fire. a NY lawyer went duck hunting in rural texas. he shot and dropped a bird, but it fell just on the other side of the fence.
as the lawyer climbed over the fence, an old farmer drove up on his tractor and said he was tresspassing. the lawyer said “i shot this duck and i just need to retrieve it.”
the farmer said, “nope, i won’t allow you on my property”
lawyer: “i’m a great trial lawyer and if you don’t let me get my property i will sue you for all you’re worth”
farmer: “you don’t know how we do things in texas. we settle small disputes like this with the texas 3 kick rule”
lawyer: “what’s that?”
farmer: “1st i kick you 3 times, then you kick me 3 times, etc. back and forth till one of us gives up”
the lawyer thought he can beat the old geezer so he agreed.
the farmer plants a toe of his heavy work boot smack to the lawyers groin, 2nd kick to his head, and 3rd kick to his kidney.
the lawyer managed to get to his feet finally saying, “ok you old coot, now it’s my turn”
farmer smiled and said: “naw, i give up, you can have the duck!”

I have a personal injury lawsuit pending. How long before its settled?

Question by baploop1: I have a personal injury lawsuit pending. How long before its settled?
My lawyer contacted me today saying that he is sending a “demand” letter for $ 100,000 . What exactly does that mean and what can I expect to happen now? A lady, who was leaving a service station, hit me on my bike. My bike was totalled, I was rushed to the hospital, received several stitches to the forehead, and had 2 blackeyes, cuts, bruises, aches, and pains. I have developed severe arthritis to my foot plus my psychiatrist indicates that my depression has increased significantly. How much longer will this go on, and will I actually be awarded some money? It hasn’t been easy for me as I lost my fiance to COPD in December? My lawyer isn’t an easy one to get answers from. I’ve never sued anyone before and I don’t know what to expect.
