Isn’t God’s system of judging a little unfair and biased?

by Creativity+ Timothy K Hamilton

Question by Captain Commando, Deathdealer: Isn’t God’s system of judging a little unfair and biased?
I mean… You’re automatically guilty and don’t have a chance in hell of winning

But if you were smart enough to get in good with the Judge before the trial he will have his son be you lawyer…

(“He’s in love with me, father… Let him off”)

Does this seem like a fair and just judge?

As Lawsuits Hit the MTA, Personal Injury Lawyers Consider How Much is Too Much, or Too Little

New York, New York (PRWEB) July 8, 2009

Each year, New York City’s chronically cash-strapped metropolitan Transit Authority (MTA) spends millions to pay for damages caused to riders.

Unfortunately things aren’t looking up for the MTA. The numbers of people claiming they were injured on transit property continues to skyrocket. New York personal injury lawyers are paying close attention. The MTA receives around 3000 claims a year, according to a recent Audit committee report.

The agency, instead of trying to bring down the number of accidents and the people who suffer in these accidents, by making conditions safer is actively looking to bring the number of lawsuits down and they are appealing to the state legislature for help. One of the Authority’s proposals singles out people who put themselves in harms way.

In the past, juries have tended to look favorably upon the MTA and 96 out of 150 jury decisions last year were decided in favor of the agency.

“The problem with banning suits is where to draw the line,” says David Perecman, a New York personal injury lawyer. “The MTA should not have any special right to be exempted from personal injury lawsuits. If they are partly to blame they should pay their part . If the claimant is partly to blame they don’t get compensated for their part. That’s the law in this State. If a jury decides that a person is 505 at fault they only ger 50% of their damages. Banning the claim outright would allow the MTA to walk away from their share of responsibility. From the point of view of the law, the burden of responsibility is with the transit operator and the claimant to act reasonably and prudently.”

Each case is different so generalization can be dangerous. Anyone who finds himself or herself in a personal injury accident on the MTA or other public transit should call a New York personal injury lawyer to discuss his or her options, urges Perecman.

About David Perecman and The Perecman Firm, PLLC:

For the past 25 years, the New York personal injury lawyers, construction accident, auto accident and medical malpractice lawyers at The Perecman Firm, PLLC have championed all types of cases for personal injury. David Perecman, founder of the Firm, is the current Secretary of the New York State Trial Lawyers Association (NYSTLA) and a chair of its Labor Law Committee. Mr. Perecman’s achievements have brought him recognition as an Honoree in the National Law Journal’s Hall of Fame, in New York Magazine’s “The Best Lawyers in America” and The New York Times Magazine “New York Super Lawyers, Metro Edition”.

The Firm has recovered millions of dollars for its clients. Among the more recent victories, Mr. Perecman won a million verdict* for a construction accident, a .35 million dollar verdict** for an automobile accident, and a million dollar structured settlement for medical malpractice.

*later settled while on appeal for .940 million

** later settled for .5 million

Are Democrats truly the party of the “little guy”?

by Jeffrey Beall

Question by Cindy Loo Who: Are Democrats truly the party of the “little guy”?
How can they be? The DNC primarily consists of rich elites, financiers (George Soros&Warren Buffet) academics, heiresses, media moguls, software millionaiares and the Hollywood crowd..

As of 2004, trial lawyers had donated $ 112 million to Dem candidates compared to the ENTIRE BIG OIL industry which donated only $ 15 million to the GOP. Scumbag lawyers, ambulance chasing lawyers give 71% to Dems and 29% to the GOP. Wall Street aka BIG BUSINESS gave to the DNC, 6 of the top 15 donations to Kerry came from firms like Citibank, J.P. Morgan, Goldman Sach, etc…..

Kerry, is “worth” $ 620 million. Like he’s REALLY for the little guy.
answerman….The Clinton admin holds the ALL time record for having the greatest # of assoc. who have resigned under fire, pleaded the Fifth, fled the country, gone to jail or died under mysterious circumstances. Clinton was the first elected president to be IMPEACHED, the first to be DISBARRED from practicing law, the first to pay $ 800,000 to settle a sexual harrassement claim, the first president to have a credible witness accuse him of rape, the first to pardon a convicted traitor and drug dealer and the first to have sex with an intern his daughters age while conducting national security sensitve foreign policy. At the end of Clinton’s admin, the US was in bad shape. he left the office and the country is worse condition than when he began his term. US citizens paid more in taxes after 8 years of Clinton, he raised taxes more than any other jpresident.
contin…Under Clinton’s logging policy, forest fires caused massive economic and enviromental damage because of the dead wood that couldn’t be cleared because 58 million acres in 39 states were off limits to any logging. He vetoed retort reform. He “hired” more the 500,000 NEW federal Gvt. employees. He sold our most sacred nuke technology to the Chinese for campaign contributions. He put up a wall between the FBI and the CIA, weakening their ability to gather initelligence for national security. Information that COULD have prevented 9/11. His ‘ecomony’ surplus was the result of the technology boom, which Reagan’s tax cuts made possible.
and regarding Monica, consentual sex may a private matter, but when a sexual relationship influences a PUBLIC court cats involving the president of the USA, teh consentual sex becomes publicly relevant. Clinton obstructed justice.

Their policies support the Little Guy. It has nothing to do with the wealth of the policy makers.

A wise man once said – wedding is just an event, marriage is a lifelong commitment. Getting married is one of the most important occasions of a person’s life, and people look forward to the day they find true love and get married. While a good number of marriages last through for a lifetime, there are quite a few which collapse midway. Now, that midway could even be within a few months! While no man or woman wishes that their marriage fall through, it is an unavoidable situation in most couples’ lives. Some people decide to stick together irrespective of whether they are compatible or not, and a great number of couples decide to call it quits.

Divorce is never a happy event – though it may appear to be to a few people – and unless handled right, it leaves a scar which will remain all through the person’s life. That is where divorce lawyers come in.

Our legal profession has several specializations and one such key area is divorce. While some lawyers handle all kinds of cases including divorces and settlements, there are a lot of them who decide to specialize in handling divorce cases, and they are doing a big service to the society by bearing that burden. Being a divorce lawyer is never easy. While most legal disputes arise because of money or property (which again is money), divorce is an issue wrought with emotions, and handling emotions is a real sensitive act. The best divorce lawyers transcend their professions and become true counselors to mankind. It is true that more divorces are settled in lawyers chambers than in courtrooms – and by settlements, we don’t just mean the financial kind. Thousands of couples approach lawyers each day to apply for divorce, and only a few of them manage to get through unscathed.

Though the decision to go in for a divorce is taken in a jiffy, the decision of hiring an experienced divorce lawyer is one which should be thought over carefully. A lawyer who is not well versed with the processes and complexities that accompany divorces will only make a mess of things. There have been too many divorces which got screwed up along the way just because both parties did not take care to get good divorce lawyers.

So we come to the right question – how do we identify the right kind of divorce lawyers? Everyone knows that we are over populated with lawyers and wherever we look, we will find a lawyer or two staring down at us – whether in person, from hoardings, or from the TV. Each one says they are the best, but divorce is too messy an event to take a chance. That is where online directories come in – especially those which have user-reviews incorporated. Since online directories are a dynamic medium where information can be updated in real time, we won’t need to worry whether the phone numbers and addresses are current or not – like in a yellow pages directory. The best online directories also allow users to leave comments and reviews on listings – including for divorce lawyers – and you can read up on a few reviews to ensure that you engage the services of one who suits your requirements the best. For instance, you can choose a person of a similar age group so that empathy is high, or you can choose a lawyer who specializes in property settlements during a divorce if you expect property to become an issue during separation.

Once you zero in on the divorce lawyer you want to hire, make sure that you get all transparent with him / her. Hiding things from your divorce lawyer is not going to help, and not disclosing all information will only lead to embarrassing moments in front of the judge. Make sure that you are prepared for all eventualities – especially if you have kids and you expect them to be paraded through court. If that is the case, better to settle the divorce out of court so that the kids are spared of the bad experience.

Divorce is any day sad. Choosing the right divorce lawyers will make it a little less messy than it could get, and that is the best one could hope for in the situation.

a little legal advice??My soon to be husband has a six year old child. I have a few questons that maybe someon?

by The U.S. Army

Question by trudywannabe: a little legal advice??My soon to be husband has a six year old child. I have a few questons that maybe someon?
He and the childs mom have joint custody,, he gets her on the last weekened of the month, alternating holidays, and for summer. There has been a few things that has changed in his life within the past three months, that he had to move out of the state he was in. However, he has returned to his home state the last weekend of the month to get his daughter..but her mom was m.i.a. In a nutshell, she hates the fact that were getting married, for some reason she belives we are married all ready, since then she has avoided giving him her new cell phone number, wont tell him where they moved too, wont tell him the daycare she’s attending. Inorder to reach his daughter he goes through her mother (childs grandmother) and most of the time she doesnt answer. Now his mom gets the daughter from school every other week for girl scout, thats a definate day he knows he can talk to her. While talking to the daughter she tells daddy of the things thats been happening, such as them moving. When the childs mother finaly called him, she was irrate, saying things like she dosent want to call him at “my” number and that he needs his own phone (We live together, therefore we only have a house phone, no cell phones at this time), Also spring break was suppose to be with daddy, (according to the custody papers) He was yet again in the state to get her, and was given the run around by her about where the daughter was..he never seen her, it wasnt until that thursday, when he spoke with the daughter that he found out, she was actualy out of the state with her grandfather. This childs mother has been arrested twice within the last 4 months on drug charges, she smokes alot of weed, pops pills, and the home is a complete and utter mess. Come to find out upon the custody hearing, both parents signed a form by cps stating that the child will not be in or around any domestic violence, child abuse, or drugs..her last boyfriend/new baby daddy, beat her and hit the daughter as well. although this incident was about a year ago. Now he is going into the military in about 3 months off to boot camp, after contactin a lawyer, he was advised to work things out,(that wont happen) then he was told he will not be able to get full custody, but maybe more visitation rights, then he was told because he’s going into the military that he wont be able to get her at all, this lawyers price was 2,000 dollars. He will be flying back to his home state to get his daughter for the summer. His daughter has also told of stories where she is hit with belts, shoes, and any other objects that may be around at that time, she gets in trouble for crying for her daddy, she also said that she would not tell anyone else because she’s afraid of what her mom may do(this was said to me, then to her father, then told to us both again by her cousin) here are some questions.
1. Will he be allowed to leave the state with her for the summer being that he has custody during that time?
2. Is the military thing true? and would it be better for him to get a military lawyer once he’s in to fight this?
3.What can he do or should do in the mean time without getting his self into trouble? (most cases the court will honor the female)
4. after we are married as his wife do i have rights to this child? if so like what?

5. anything anyone can advise about this situation will be helpful, keep in mind the last time they went to court she lied on him alot, example she told the judge that the child was staying with her out of the state for the past 4 months..in all actuality the child was with him, and his mother during that time, she would not show up to court, so her lawyer dropped her. I KNOW THIS IS ALOT…BUT TRUST THIS IS ALL IN A NUT SHELL..ANY ADVISISE? SUGGESTIONS? LAWYERS? CPS WORKERS? SOMETHING, I JUST WANT TO HELP, THIS IS MY HUSBAND AND BFF FOR SEVEN YEARS, AND THE CHILD AND I HAVE SUCH A CLOSE RELATIONSHIP.

Best answer:

Answer by keiko
He needs to petition the court where the custody agreement was filed and ask for another hearing. He, not you, can approach CPS and express concerns. An ex being so jealous and using a child as a weapon seems to happen all the time. He needs to move close to where the child lives. Why is he going into the service with this problem going on? Whether he can leave the state should be in the custody agreement papers. Skip the lawyer and contact the court directly.
