What kind of lawyer do I need?

Question by ﺕ SB22 ټ: What kind of lawyer do I need?
There’s 2 properties, one worth $ 280k & the other worth $ 75k. The properties & my ex husband are in Alaska, I’m in Colorado with a disability, making it impossible for me to travel there & take care of things myself. They are in his name only. I do not have any knowledge of real-estate or property laws & I have been severely screwed over by my ex, his shyster lawyer & the divorce trial Judge already. I trust no one in the so-called “justice” system anymore.

My ex is supposed to sell the properties (that are considered marital assets) & he gets to pay off any & all of HIS debt with the proceeds, then whatever is left over, he is to give me 60%. But nothing is selling & he keeps adding all he wants to this so called debt. He now claims it is $ 85k & he has recently implied that I’m liable for half of it. Which I’m not. But he’s got a lawyer & judge in his back pocket & will do whatever it takes to screw me over yet again.

Well, he just made me an offer to settle, but I don’t like it, at all. Its sneaky & deceitful, just like him.

So, do I need a lawyer? What kind of lawyer should I get, a property lawyer or divorce lawyer, or something else? & which state should I look for one, Colorado or Alaska? I do not have any money to hire a great lawyer, not that I know how to find one anyways, & I know that lots of lawyers offer free consults, but will this be enough to get the legal advice I need? How do I find the right lawyer?

We have no children together & were married 21 years. My name is not on the properties, because he bought them as part of his business while we were married.

Any suggestions would be helpful. Thank you!

You have already been to court? (divorce trial judge seen). Did you not have a lawyer?

You need a Divorce lawyer who will also work out all the details of the assets and debts.

The first visit is usually free. If you know someone who was happy with their divorce lawyer, use their person. You can see several lawyers for that first free visit, and decide who you prefer. Ask first if the first visit is free. Good luck.

What kind of Lawyer are we supposed to consult?

Question by SUNNY: What kind of Lawyer are we supposed to consult?
Okay so Long story short, my poor dad at a tender (still young) age of 59/60 got all his teeth taken out to get dentures. He paid thousands and thousands of money (that we didn’t really have) to pay for these POORLY made dentures that did not fit him well, and caused him much pain.

They(the damn dentist) replaced them with new ones a couples times but they were still coming off, giving him sores, etc, etc.

Eventually they are refused him of any more service and told him to basically “go somewhere else”.

They say that its his mouth that is “different”……seriously?

Now my dad has no choice to eat his food with dentures that keep coming off, cause him pain…and even has SCREWS coming out while he eats.

We really can’t afford to be going somewhere else and getting them redone, but we really have no choice. My parents want to sue them, but its really difficult being that they don’t speak much english. I really want to help them out, but I really don’t know much either.

What kind of lawyer is this?
Medical Malpractice?

Do you guys think we have a good case?

Best answer:

Answer by Robbie
You need a personal injury lawyer. You may have a case. Do you have records, witnesses to statements that were made?

You could start with a well worded letter from yourself. Try not to be emotional. Simply state the facts and state what you want – money deposited into bank account number XXXX or repair of the problem. State that if this is not done within 7 days you will 1) report the matter the relevant dental association and request disciplinary action and 2) Hand the matter to your lawyer to persue justice through the court system. To get the amount demanded you will need an assessment of what it will cost to fix from another (better) dentist.

Don’t think just mal practice there, are many ways to approach this issue. That’s what the lawyer is for. Yes, for a negligence or mal practice claim it would have to be a severe error but your lawyer may find that there is a contracts issue here. There may be a number of ways to approach this problem. Also the lawyer will use any possible embarrasment to the dentist for the poor work done to the benefit of your father.

Many personal injury lawyers will do no win no fee (remember, this is not free, as there are costs other than the cost of the lawyer). It is worthwhile having a talk to a lawyer, you should be able to find someone who will give you 30 minutes to outline your story without charging.

Try the letter first though. It’s quick and cheap and can be used as evidence later if neccessary.

Good luck.

Tort or personal injury. Any civil lawyer will really do, but you’d want someone that specializes in tort or personal injury.

Why do companies get away with this kind of crap?

Question by jeremy l: Why do companies get away with this kind of crap?
While the national headlines focus on efforts across the country to force Wal-Mart to pay more for its workers’ health insurance, an obscure story in Missouri reveals just how “sick” Wal-Mart’s health care policies can be. The story involves a former Wal-Mart worker who received some medical care benefits from Wal-Mart, but now the retailer, which made $ 10 billion in profits last year, is suing the disabled worker to get the company’s money back. According to the St. Louis Post Dispatch, last June Wal-Mart decided to sue Debbie Shank, who stocked shelves at night at a Wal-Mart in Cape Girardeau, Missouri, so she could spend the days with her three kids. Debbie was in her minivan in 2000 when she was hit by a truck. She suffered severe brain stem damage, and has been left totally disabled. After the accident, her Wal-Mart health insurance paid for her medical care. But when Debbie sued the trucking company, and won a financial settlement of roughly $ 900,000, Wal-Mart decided it wanted Debbie to pay Wal-Mart back. But Debbie’s husband says the money they received from the lawsuit has been used to set up a trust fund to help pay for Debbie’s care, since she now requires expensive nursing home care. Wal-Mart says it has a legal right to try to recoup its medical expenses from Shank, once she won her lawsuit. “This is a very sad case, and I think many people naturally have an emotional and sympathetic reaction,” a Wal-Mart spokeswoman told the Post-Dispatch. “But the reality is that we are required to protect the assets of our health plan so that it can pay the future claims of other associates and their family members. Unfortunately, it’s just not feasible to start making individual exceptions.” But Wal-Mart knows that to the public, it will appear that they are trying to get money from a disabled woman, her three children, and her husband. Shank is confined to a nursing home, and will not work again, and cannot financially help her family out by working nights at Wal-Mart. So Wal-Mart is worried that its lawsuit against a disabled woman will not seem right. “Not everyone will understand this,” the company spokesman admitted, “and I’m sure that we will get a fair amount of criticism.” Debbie Shank’s lawyer said, “If somebody got some money from a lawsuit and used it to buy a new home they didn’t need or a European vacation … that’s one thing. But that’s not the situation we’re dealing with here. In view of the unfavorable publicity that Wal-Mart is getting around the country …I’m surprised they’re pursuing this against their former employee, particularly since she remains so devastated and so in need of these funds.” Shank’s husband, Jim, says his wife is still so mentally confused that she can’t always identify which son she is talking to, and that she is wheelchair bound, and, due to her brain stem injury, can only move one arm and two fingers. The Shank family got around $ 417,477 from the lawsuit, and that money was put into a trust to pay for Shank’s future medical bills, which will be very substantial. But Wal-Mart wants to get their medical expenses back, so they can deposit them in the company’s Health and Welfare Plan. Shank says that if his wife loses her case to Wal-Mart, she will lose more than money. She will lose her private room at the nursing home, her wheelchair-accessible van and the personal care worker who helps her with her activities of daily living. Jim Shank has health insurance, which pays for some of his wife’s on-going medical bills. Shank works at several jobs to make ends meet, including real estate sales, and work at a local department store.

They get away with it because of crroked lawyers, and a justice system that favorsthe rich. Also, government regulations are very lax, while the legislators award themselves goldplated health care and pension plans. It has been this way forever.

What kind of education do lawyers learn about? What types of lawyers are there?

Question by James Y: What kind of education do lawyers learn about? What types of lawyers are there?
And obviously, dont’ answer with “they learn about the law.”

I’m just wondering about the things lawyers do…ANYTHING at all about lawyers (including any emotional results you or someone you know experienced, because of being a lawyer).

In the past, and presently, being a lawyer always appealed to me, but I have no idea why, considering I know almost nothing about it.
Also, if there is a recommended level that lawyers should be at (by level I mean a bachalor’s degree, master’s degree, PhD, etc), how many years would it take to reach it?

You seem interested in a lot more than what you are asking, so if you like to do research, check out this site:
It has links to different things that lawyers learn about, you can find out different types of law, and check out what you should be doing if you are interested in a career in law.

Lawyers have so many different things they do, that they learn different things. Something they all learn is how there are different interpretations of the law, and how to research, and how to make a point.

All law students in the US are required to have a Bachelors and generally require 3 years of law school.

Best answer:

Criminal Lawyers do very well in California. If they have a great memory it makes the job a lot easier.
The amount of time it takes can vary by each individual. Work hard and focus on your education and it will be worth the time you invest.
