Why the Insurance Industry Wants to Defeat Referendum 67

Karen Koehler, President of the Washington State Trial Lawyers Association, recently wrote a letter to the state bar accusing the insurance industry of using slanderous and reckless television ads against trial lawyers. The insurance industry has already spent .7 Million to defeat Referendum 67, the law up for vote this November. Referendum 67 is designed to force insurance companies to treat their policy holders fairly during the claims process. Proponents of Referendum 67 have raised over 0,000 mostly from trial lawyers.

With support from Democrats and Republicans alike, the Washington state legislature enacted Referendum 67 into law earlier this year. The insurance industry was unhappy. So a handful of out-of-state insurance companies spent millions to obtain more than 150,000 signatures to put the law up for a vote this November. The insurance industry has cleverly called itself “Consumers Against Higher Insurance Rates.”

The major argument against Referendun 67 is that the new law will increase insurance premiums for everyone. But this makes me wonder. Why would the insurance industry spend .7 Million to defeat a measure that could conceivably give them an excuse to raise premiums and make even more money off of Washington State citizens? Do you smell a rat with this line of reasoning? I mean, are you telling me that the insurance company really cares about saving us consumers as much money as possible by paying lower premiums?

And what about good ol’ market forces at work? If insurance companies choose to violate Referendum 67 and as a result then must increase their rates, won’t this provide an incentive to other insurance companies to comply with the law so they can keep their rates low, and hence gain more market share and increase profits as a result?

Follow the money. There is something remarkably suspect about an entire industry spending millions and millions to defeat a measure that is designed to protect consumers (that’s you and me) from being screwed by that industry. Are the citizens of this great state really to believe that the insurance industry is really concerned about our pocket books? And saving us as much money as possible? (yes, I’m smirking…)

What about triple damages? Some people have problems with this part of the law. But you really have to understand the business of insurance and why this provision is absolutely necessary. First, the only incentive for insurance companies to obey the law is the prospect of losing money or paying out more money if they are caught cheating or acting unfairly. Second, more and more carriers employ the tactic of spending much more money to fight a case that could be settled by a much lesser amount. Many people are surprised to learn that many insurance companies will spend ,000 to fight a ,000 claim. Why? Because of the policy of discouraging people from hiring attorneys and asserting claims. Probably 80-90% of claimants will usually fold and accept the company’s last low ball offer rather than hire counsel and litigate. The carriers know this, and they make sure the other 10-20% who choose to fight will know how difficult it will be to recover on a legitimate claim. In the end, the carrier still makes alot of money off of those claims that are settled for a fraction of what the claimant is legally entitled to receive.

How fast can a personal injury claim against an insurance company take?

Question by estradaer: How fast can a personal injury claim against an insurance company take?
I’ll try and keep this simple. I had two “friends” jump on my back while I was asleep. They broke my neck and I was in the hospital for 2 months and had neck surgery. Some nurses thought I was going to die when I was brought in to the ER. I am learning to walk all over again and will not be back at work for a long time. This is a life changing injury although my surgeon expects a 100 percent recovery.

Now I have a lawyer who is going after the homeowners policies of both parties for the full amount of personal injury liability. He thinks he may get some “cash” in 3-4 months. Both parties are cooperating and admit they were at fault.

How long can something like this really take and can I expect the full amount possible in this case. For example one party has 300,000 coverage for personal injury. Should I expect all of that? My lawyer is old school and wont accept the first number he hears and he has a private investigator getting statements and following up on things.

Really want to have an idea of how much waiting and how much money a situation like this will turn out.

It can take forever depending on the insurance company.

No fault insurance plans are actually being implemented in California to Rhode Island but the well financed lawyer’s lobby does not agree with this. People’s rights to recover from certain injuries (which really don’t have a fixed monetary value) are strictly controlled by the no fault proposals which is one of the reasons why lawyer’s tactics varies, according to the American Trial Lawyers Association. He said the limitations affect both those victims who try to settle claims out of court and those who file suit to recover for damages. The trial lawyers’ group in Illinois spent around 0,000 just to have the bill killed, but they were unsuccessful.

After the no fault proposal was declared as a law, the Illinois Trial Lawyers Association filed a suit. Certain groups of accident victims are not favored by law and with this, the State Supreme Court declared it unconstitutional. As what the group of lawyers in Arkansas and California disputed that no fault bills refrain persons from bringing their problems in court. The Trial Lawyers Association in New York is definitely not in favor of a pending bill which indicates that people’s rights to sue is being denied and that damages for injuries will not be compensated.

Expect more heated arguments because the main counter of trial lawyers is beginning to come about. What they plan to do is to introduce in Congress a Federal Automobile Insurance Reform Act that would contain the tort damage lawsuit right, which in other words is the extreme version of ‘no fault’ that supporters want to get rid of. Its own no fault provision is what the trial lawyers’ bill has. Right away, auto accident victims would receive their compensation from the new Federal government corporation wherein the money to be given to the victims would come from the national gasoline tax. They would still be paid even if they were guilty or if they do not have an insurance policy.

The guilty driver and his insurance company would still be liable, and the court will deduct the amount that the driver received from the government firm but even so, the right to sue and collect from the guilty driver would be retained. According to the general manager of the Trial Lawyers Association and professor of the Boston University Law School, these guilty drivers are no longer scared of the no fault idea, they just want to tort the legal system and they see the no fault as a reasonable social welfare principle instead of an insurance gimmick. According to him, trial lawyers do believe that the proposed federal corporation has the ability to shoulder over 90 percent of all personal injury claims.

Since such facts have been stated and that the government already shouldered deductibles, don’t be surprised if rates for injury liability insurance would go down. With this, there is a possibility for most states to make this coverage a requirement. Then if that happens, government would now have to shoulder ,000 per head. A total of 90 percent of all personal injury claims which essentially covers hospitalization costs, medical care and loss of income are what the immediate payments will comprise of. Those people who would not be receiving any immediate payments are persons who drive drunk and are under the influence of drugs, those driving without license and those involved in a violation against the law.

Private insurance companies are now competing with the government because the Trial Lawyer’s bill currently authorizes the government to sell insurance policies, but it does not have anything to do with the present collision, property damage liability and auto fire and theft insurance system. With this, the Government Company would then be allowed to sell personal injury liability insurance. But still, motorists would have to pay for such coverage.
