According to a recent study from the researchers at the Nova Scotia Dalhousie Medical School, embryonic stem cells may offer muscle restoration for victims of an injury, including a traumatic brain injury, and who have suffered from nerve damage or motor neuron conditions.

Scientists from the medical school found that embryonic stem cells that were grown in the laboratory could be transplanted to the damaged neurons in an injured victim and could be reproduced. Scientists explained that the project “opens the door for a variety of different treatments.”

Coping With A Traumatic Brain Injury

As more Americans become at risk for developing a traumatic brain injury, especially those returning from the war in Iraq, it is important that the appropriate treatments and support are sought. Unfortunately, many brain injury treatments are quite expensive and may not be covered by insurance companies because of experimental or new treatments.

Developing litigation, if this occurs, may be necessary for a victim to receive a reward of monetary means to pay for a costly brain injury treatment. A brain injury lawyer can provide details on developing a lawsuit as well as how a victim might receive monetary compensation for their injury.

Injured on the Job in Colorado? What You Need to Know About Workers’ Compensation

What is Worker’s Compensation?

Workers’ Compensation, is a state-mandated program that provides compensation to employees who suffer injuries and illnesses on the job and are subsequently unable to work and support themselves and their families. In addition to helping injured workers continue to pay their bills, these laws act as both a safety net for Colorado employers as well as their employees. In Colorado, businesses must have workers’ compensation insurance to cover employee injuries.

Workers’ compensation laws are designed to ensure that employees who are injured on the job receive fixed monetary compensation, without having to litigate their claims against their employers. Thus, filing a workers’ compensation claim is similar to filing an insurance claim; it isn’t a lawsuit against an employer, but rather a request for benefits form the Colorado state government.

What Types of Injuries are Covered in Colorado?

Here are some types of injuries covered according to Colorado workers comp laws:

1. Injuries resulting from mental and physical strain brought on by increased work duties or work-related stress

2. Injuries caused during breaks, lunch hours, and work-sponsored activities, and at-work injuries caused by company facilities

3. Pre-existing conditions that the workplace accelerates or aggravates

4. Diseases contracted by exposure to toxins at work as a result of normal working conditions

Does it Matter who is at Fault?

Workers’ compensation is a no-fault system, where an injured worker’s own negligence, or the negligence of his or her employer or co-workers, is not at issue. Instead, the employee is covered for all work related injuries, regardless of who was responsible for the injury. The employer’s workers compensation insurance simply compensates the employee for his or her workman’s comp claim.

This also means that the employee is generally not eligible to take legal action against his or her employer for injuries sustained on the job. In Colorado, these types of claims are considered to be a sort of substitute for a lawsuit against an employer. In exchange for not suing the employer in court, an employee who is injured at work is entitled to workers’ compensation benefits

Many workmens’ compensation claimants are still eligible to take legal action if their injuries were caused by someone other than their employer. For example, employees injured by a defective product or defective equipment while on the job can take legal action against the manufacturer of the product or piece of equipment.

This action takes place within the civil court system, rather than through the worker’s compensation system. However, if a claimant for worker’s compensation does win monetary compensation in a civil court from a third party, the claimant’s employer and his employer’s insurance company are eligible to recover some or all of any of the successive benefits and payments awarded to the claimant.

If you are unhappy with the decision in a hearing that was held to determine some aspect of your claim, there are a number of procedures available for you to appeal the unfavorable result. For more information about filing worker’s compensation claims and/or workers comp information in Colorado, please visit the worker’s compensation section of the Colorado Department of Labor

Should I Hire an Attorney?

Due to the rigid procedural requirements of filing a these kinds of claims in addition to the high probability that your employer’s insurance company will pursue every legal avenue possible in an attempt pay the smallest amount of benefits they owe you, it is highly recommended that you contact a Colorado attorney experienced in personal injury or workers compensation if you are injured on the job in Colorado. .

An experienced and competent attorney will guide you through this sometimes complex and confusing process and get you the compensation and treatment that you deserve. If you’ve been injured on the job in Colorado, don’t take on the insurance companies alone – contact an experienced in Colorado worker’s compensation attorney today to level the playing field.

Scientists have developed a new method of administering a mild electrical current to improve motor skills in a traumatic brain injury victim.

The newly discovered method of treatment was published in the Proceedings of the National Academy of Sciences. The study followed subjects who had suffered from stroke and traumatic brain injury (TBI) and placed victims in a duration of tests including squeezing a joy stick during a computerized targeting game.

The participants were divvied into two separate groups; one group received the real electrical current, a method known as the transcranial direct current stimulation (tDCS), while the other group received only a mock simulation of tDCS. The first group that received the real tDCS therapy was found to have “improved significantly more than that of the control group,” according to news reports on the study.

What is Traumatic Brain Injury?

According to the National Center for Injury Prevention and Control (NCIPC), which is part of the Centers for Disease Control and Prevention (CDC), a traumatic brain injury occurs after a “blow or jolt to the head or penetrating head injury” occurs, disrupting the regular functions of the brain.

A brain injury can vary in severity as well as stages — from mild to moderate to severe and fatal. No matter if a TBI victim shows no signs of an injury, it is important to receive medical assistance, as the onset of brain injury side effects may occur much later, and become more harmful to a victim.

The CDC reports that if an individual is involved in an incident, but are unsure if they suffer from TBI, that they should try to recount whether or not they have been victim to any of the following brain injury signs and symptoms:

* headache

* continued neck pain

* difficulty remembering/concentrating

* slowness in actions/thoughts

* easily confused

* feelings of sleepiness/exhaustion

* dizziness

* blurred vision

* sensitivity to light

* loss of sense of smell/taste

* ringing in the ears

* nausea

* mood changes

* sleep pattern changes/disruptions

Seeking Assistance

It is common for a traumatic brain injury patient to feel stress and isolation after such an incident occurs. However, it is essential that a TBI victim receive the appropriate diagnosis and treatment for their condition, which is vital to their improvement and success in overcoming such an injury.

Additionally, brain injured victims may find it necessary to locate an experienced brain injury lawyer who can offer details into the victim’s unique traumatic brain injury case. If a TBI victim suffers from job loss or loss of income as well as increasing medical bills or onset of disabilities, they may be eligible to receive monetary compensation for their brain injury.

Such an injury and the after effects of a TBI incident may result in huge financial tolls on a victim, their family and friends, which is why creating a traumatic brain injury lawsuit is a possibility to consider as monetary funds may be compensated to a victim for the loss and difficulty endured.
