Who’s going to make more money from AZ’s immigration law; the crooked lawyers or the private prison system?

Question by greasytony: Who’s going to make more money from AZ’s immigration law; the crooked lawyers or the private prison system?
It’s seem that these two giants are going to be the only ones benefiting from this immigration bill. Who’s going to make more money and why?

Jan Brewer’s CCA Money and Her Possible Conflict of Interest Over SB 1070

In all, seven executives with the Tennessee-based private prisons giant Corrections Corporation of America contributed $ 980 for the governor’s start-up fund with Arizona’s clean elections system. A warden for one of CCA’s Arizona prisons gave $ 100. A CCA shareholder gave $ 140.

“The more folks that get pulled over and detained, the more money CCA makes,” said Monica Sandschafer, executive director of the Phoenix immigrant rights group LUCHA, which stands for Living United for Change in Arizona. “It’s a pretty disturbing connection between Brewer and this company.”

Russell Pearce’s SB1070: Welfare for Anti-Immigration Lawyers, Says Attorney David Selden

In this video by Dennis Gilman, Phoenix attorney David Selden describes how the bill is a huge boondoggle, which will line the pockets of nativist lawyers such as Kris Kobach, the guy being paid $ 300 per hour to advise Sheriff Joe Arpaio’s deputies on immigration law.

Are terrorists that are tried in civilian courts going to be able to claim they were not given their Miranda?

by stargonautone

Question by John: Are terrorists that are tried in civilian courts going to be able to claim they were not given their Miranda?
rights?

Regular people in civilian courts get off scott free if they were not read their rights before questioning and given the opportunity to talk to a lawyer.

“Khalid Sheikh Mohammed is going to meet justice and he’s going to meet his maker,” White House spokesman Robert Gibbs said on Sunday.

How can you have a fair civilian trial without the presumption off innocent until proven guilty? Couldn’t a sharp lawyer use the White Houses statements against the prosecution and say that the government has made it impossible for a fair trial?

Best answer:

Answer by Cactus Jack
Probably not. If Miranda rights are not read that does not taint the entire case. Most courts will just not let the prosecutor use incriminating evidence from the accused before he got a lawyer if he was not informed of his right to a lawyer.

Business files deeIs this business JetAway going out of business? Are the owners selling? What does this mean

Boise Attorney
by Village Square

Question by swingydude: Business files deeIs this business JetAway going out of business? Are the owners selling? What does this mean
MONTROSE — JetAway Aviation has placed a lien, amount unknown, against property it claims to own in Montrose. If JetAway Aviation defaults on repaying its lender, the public trustee of Montrose County can be directed to sell the property — meaning members of the Girdner family could be first in line for any of those benefits, a deed of trust filed Dec. 20 indicated.

JetAway, a limited liability company, along with another LLC, One Creative Place, executed a deed of trust that identified its lenders as Paul and Michael Girdner of Boise, Idaho.

Michael Girdner also signed as the borrower, on behalf of both LLCs, which is not unheard of, a local escrow agent told the Daily Press. The notarized document certifies that Girdner is a “manager or managing member of JetAway Aviation, LLC,” and he would therefore have the power to act on behalf of the company.

JetAway CEO Stephen Stuhmer did respond to a request for comment.

JetAway, located at 1 Creative Place adjacent to the Montrose Regional Airport, is locked in a heated and expensive legal battle over Montrose County’s decision to award a competitive bid for fixed-base operations at the airport to another company. The county and JetAway will head to court in May after Federal Aviation Administration-sponsored mediation terminated.

The successful FBO bidder, Black Canyon Jet Center, also succeeded in having JetAway held in contempt over the advertising of fuel sales, which court orders barred JetAway from doing.

Paul Girdner testified at the November contempt hearing that he pays the company’s bills. Testimony indicated he was a financial backer.

The Daily Press showed the deed of trust to its attorney, who explained how such deeds operate.

David Masters said a deed of trust, similar to a mortgage, uses property as collateral to secure financing. In a deed of trust, the borrower transfers the property to the public trustee to be held in trust, subject to the terms of the deed.

The Dec. 20 deed places its property in trust with Montrose County Treasurer Rosemary Murphy, who can be called upon to sell it if terms are not met and a demand for sale is made

The company has chosen litigation perhaps because it is uncompetitive. Bad situation for everybody involved.

Is there really no going back to “square one” in a court case when you get a terrible lawyer to represent you?

Question by Jason: Is there really no going back to “square one” in a court case when you get a terrible lawyer to represent you?
My wife had a horrifically bad lawyer represent her in her unemployment hearing (state appointed)…is there any way to get a new hearing if your representation is THAT BAD? if so, how would you go about this? seems unfair to punish a person w/ no legal background when their appointed lawyer is incompetent. Please advise…thanks!

Answer by NeoNerd
You can appeal. If he was that bad, you should have dismissed him and appointed someone else – you’re not obligated to keep the same lawyer.

Q&A: File a Trademark and/or Copyright on Legalzoom.com vs going downtown?

Question by FAshionPassion: File a Trademark and/or Copyright on Legalzoom.com vs going downtown?
Okay so I have a set of comic book stories that I’m writing. Is Legalzoom a good place to go to for TM? I need to get the name protected (title) so others making comics won’t use it. I also need to start protecting the names of my characters (mostly so if and when this gets big, I can make action figures).

I was told legalzoom sends you a bunch of papers to read. Now are they designed so that an average person can read it or will it look all legal and stuff like contract? (Big words and sentences that don’t make sense and you need a lawyer to translate for you) =).

Lastly copyright question. Okay for each comic book issue am I gonna have to copyright it separtately or can I bundle it together and copyright it?

thanks for ALL THE HELP

P.S. I know some peopel might mention you can’t protect a name, but Barbie sued Bratz because say Bratz was making a doll named “Camilla”. Well Barbie sued saying they have a doll named “Camilla.” That’s not fair to me, and it seems dumb. That’s a generic name. It’s not like it’s a known name and identity like the name “Mickey Mouse.”

I also saw where Marvel threatened a kid b/c he had Superhero in his comic title and Marvel said they owned the trademark to “superhero, super hero, etc)

I went through Legal Zoom for a Provisional Patent. I still think that is how my idea got out. I’ve learned a lot since then.
Since you are protecting your comic, just go the the us.gov web site. Its a lot of reading but you can do it yourself and save money. Legal Zoom is not there for legal advice. They ONLY file the paperwork for you. They will suggest legal advise at an extra fee.
I suggest you check into filing yourself.

Q&A: Why are so many of the Army Soldiers going AWOL?

Question by Erudite Pejorative”: Why are so many of the Army Soldiers going AWOL?
U.S. Army prosecutions of desertion and other unauthorized absences have risen sharply in the past four years, resulting in thousands more negative discharges and prison time for junior soldiers and combat-tested veterans of the wars in Iraq and Afghanistan, military records show.

The increased prosecutions are meant, in effect, to serve as a deterrent to a growing number of soldiers who might be looking for a way to avoid heading – or heading back – to Iraq, The use of courts-martial for these violations, which before 2002 were treated mostly as unpunished nuisances, is a sign that active-duty forces are being stretched to their limits, said military lawyers and mental health experts.

“They are scraping to get people to go back, and people are worn out,” said Thomas Grieger, a senior Navy psychiatrist.

Some soldiers are cutting of trigger fingers to keep from going back to Iraq said Thomas Grieger. They know the war is wrong and the USA is losing.
