Man Falls to His Death From Apartment Terrace in New York, Personal Injury Lawyers Comment

New York, New York (PRWEB) March 29, 2010

Connor Donohue, a 24-year-old New York resident plummeted to his death on Sunday, March 14, after the rail of his 24th floor Murray Hill terrace broke away. New York City personal injury lawyers like David Perecman wonder about unsafe building procedures.

The building had fielded many prior complaints about the state of the balconies, which residents have described as “wobbly”, “crumbling” and “insecure”. In one apartment, the horizontal bar along a side of the balcony railing wasn’t even connected to the corner vertical post. With slight effort, the entire thing shook.

Officials speculate that Donohue, a well-liked social worker, was most likely leaning against the railing’s loose vertical bars before he fell.

Jennifer Towers Apartment Corp., located at 330 E. 39th St., is owned by real-estate tycoon Fraydun Manocherian. The Department of Buildings says the building failed to properly inspect its exterior and balconies as required by law and has ,750 in outstanding fines.

The New York building owner was required to hire engineers to inspect the structure’s exterior and submit a report to the Buildings Department by early 2007

The building is now under investigation and residents are forbidden to go out on their balconies until the building owner submits an engineering report that says they are safe.

The Department of Buildings is now trying to determine if other balconies around New York are at risk.

New York personal injury lawyers say that New York City law requires owners of buildings at least seven stories high to hire private engineers to inspect the exterior walls, air conditioners and balconies every five years. The reports then needs to be submitted to the DOB.

In order to obtain compensation for the family of the young man in New York, personal injury lawyers need to show that the building’s owners failed to reasonably maintain the terraces. The family will however, be surprised when they find out that there is no compensation under NEW YORK law for the loss of the love, companionship and affection. All the law allows is the loss of support to the family members who he would have provided it to. Since he was young and unmarried that will likely be NOBODY.

Girl Falls 30 feet through a Skylight and New York Personal Injury Lawyer David Perecman is not Falling for Excuses

New York, NY (PRWEB) May 28, 2009

A girl falls 30 feet through a skylight and New York personal injury lawyer David Perecman knows that this is a lucky fall. A 30-foot drop has the potential to cause far more severe injuries then only the broken arm and leg suffered by the eight year old. A fall like this can be fatal.

Mr. Perecman and other New York personal injury lawyers wonder why there was no railing around this skylight that was located next to a rooftop playgroup.

“This fall highlights the need for building managers and owners to carefully monitor the health and safety procedures in place,” says personal injury lawyer Perecman. “Building managers must practice good risk management practices and view it from the eyes of a child.”

The girl, whose name was not released, was walking towards a staircase to retrieve a ball that had fallen to the street when the skylight she was walking on gave way. No one else was injured.

The school the girl was attending shares its space with a popular Jewish wedding hall. The skylight allows for couples to marry in accordance with the rules of a traditional Jewish wedding, which requires an “open sky directly above” the ceremony. New York personal injury lawyer Perecman is quick to point out that an 8-year old girl would not understand the dangers associated with stepping onto an unfenced skylight near a playground.

New York personal injury lawyers predict that if this case goes to trial the building managers and owners are going to have a difficult time defending the lack of precaution. New York State law requires landlords to take reasonable precautions in the face of potential injury and the failure on their part to do so will see liability fall on them.

New York City Personal Injury Attorney Supports Falls Prevention Awareness Day

New York, NY (PRWEB) September 22, 2010

New York City personal injury attorney David Resnick says Falls Prevention Awareness Day, scheduled for the first day of fall on September 23, serves as a valuable reminder that preventable falls are one of the leading causes of injuries, deaths, hospitalizations and emergency room visits among adults age 65 and older.

“A slip and fall, or a trip and fall, is not a random accident,” Resnick says. “All too often, older adults are injured or killed in a fall that was the direct result of a property owner ignoring risk factors and failing to provide a safe environment for the people on their premises.”

Resnick, a leading New York City slip and fall lawyer, and his law firm, David Resnick & Associates, recently launched www.nyc-slipandfall.com, a website that provides information to residents of Manhattan, Brooklyn, Queens, the Bronx and Staten Island on the factors that cause falls and the legal options that may be available to those harmed in a fall.

As the website points out, a slip and fall due to the negligence of a property owner can occur anywhere, including shopping malls, grocery stores, department stores, hotels, train stations and on sidewalks.

The website describes several New York City slip and fall cases successfully handled by David Resnick & Associates, including those involving elderly victims.

“A bad fall can cause a lot of pain and suffering and loss of income, and it can change a person’s life,” Resnick says. “When it happens because a property owner ignored a hazard, we believe the injured should be given prompt and full compensation.

“A lawsuit also protects others from future harm caused by the hazard. In my experience, in a New York City broken sidewalk case, it is a lawsuit following a fall that precipitates the sidewalk being repaired by the adjacent property owner.”

Although a serious fall can happen to a person of any age, statistics show that older New Yorkers are more susceptible to slip-and-fall accidents, with often devastating results for them and their families, Resnick says.

According to the New York State Department of Health, an average of 894 New York State residents ages 65 and older die each year from a fall, while nearly 50,000 are hospitalized.

Among those older New Yorkers who are hospitalized because of a fall, 10.8 percent suffer a traumatic brain injury, and 28.4 percent experience a hip fracture.

“An event such as Falls Prevention Awareness Day provides an excellent opportunity to increase public awareness about how to prevent and reduce these falls,” Resnick says of the national initiative that is being spearheaded by the Falls Free™ Coalition, which includes 34 states (including New York) and 70 national organizations, professional associations and federal agencies.

Resnick says he hopes the September 23 event calls attention to the most common causes of slip and fall accidents, including clutter in walkways, aisles or stairs; icy, wet or uneven surfaces, such as sidewalks; poor lighting; and lack of railings or grab bars.
