What To Expect from My California Personal Injury Lawyer?

No one plans to become the victim of a personal injury accident. If you have recently found yourself in the position of being a victim of a personal injury accident you are undoubtedly feeling worried, frustrated and probably confused among other emotions. These are all common and normal feelings after an accident. To further complicate matters, although you may realize that you need to hire a California personal injury lawyer, you may not understand what he will actually do for you. A victim of a personal injury accident should have a full understanding of what to expect from her California personal injury lawyer. Although many things may be out of your control at the moment, one thing that you can control is pursuing your legal option through the use of a California personal injury lawyer. By understanding what to expect from your lawyer you can start to feel that you are back in control of your life.

First, and foremost, you can expect that your California personal injury lawyer will act as your voice throughout the entire legal process. From the day you hire him, he will communicate on your behalf with the defendant, his insurance company and the courts. What this means to you, the victim, is that you can spend your time focusing on healing instead of adding the additional stress of worrying about who you need to talk to or what you should or should not say to them. In fact, once you have retained the services of a California personal injury lawyer no one involved in the case should attempt to communicate with you at all for any reason.

The next thing that your California personal injury lawyer will do for you is assist you in locating the medical evaluations and treatment that you need for the injuries you have suffered. Many victims of a personal injury accident find themselves with costly medical bills and inadequate insurance coverage or no insurance coverage at all to pay for the treatment they desperately need. Your California personal injury lawyer can help you locate the medical care that you need from physicians that will work with you regarding payment or will agree to wait until your case is settled for payment. Proper medical care is crucial to a victim after a personal injury accident and the cost of the care should not prevent you from receiving the care you need – particularly if someone else was responsible for the accident.

Once you are on the road to recovery, your California personal injury lawyer will begin to gather all the necessary documentation to evaluate the damages in your case. Damages is a legal terms used to refer to your injuries – both economic and non-economic. Economic injuries are those injuries that are quantifiable such as lost wages or medical bills. Non-economic injuries are more subjective in nature and include things like pain, suffering, loss of consortium and emotional distress. Your California personal injury lawyer is experienced at valuing both aspects of your personal injury case and will work to get you the maximum amount of compensation possible for the injuries you have suffered.

A major chunk of the accidents happen on the road. The most common cause of a car accident is drunk driving or simple negligence of traffic rules. The victim of such an accident suffers mental and physical agony. Often, the injured person gets bedridden for a long period of time. Injury often results in loss of pay for the injured person. A serious injury brings a persons life to a standstill. It puts a stress mentally and financially on family members of the injured. The injured person might recover physically from the injuries but will find it difficult to recover from the financial set back without proper compensation. Often the guilty try to escape giving the compensation to the victim of their negligence. A Personal Injury Attorney helps in bringing justice to the victim by suing the culprit.

Personal Injury Attorney also known as Personal Injury Lawyer is a, or set of professionals who has the legal license to represent a victim who has undergone physical and mental trauma due to somebody else’s fault. These lawyers practice a special branch of law known as tort law. According to tort law one is entitled to sue a person who causes economic, physical and physiological harm. Upon winning the case, the victim is entitled to claim damages and compensation from the person at fault. Lawyers who practice tort law also include Car Accident Lawyer or Auto Accident Lawyer.

Accidents are inevitable and can happen anywhere at any time. Most of the time, one is injured due to others negligence. The injured has to face too many hurdles to claim compensation from the person at fault as well as from insurance companies. Such hurdles can be eased out with the help of a Personal Injury Lawyer. He or she ensures that insurance companies and culprits who cause the injury respect the claims of the injured. The insurance companies generally do not cover the emotional trauma experienced during the accident. They try their very best to pay only half of the medical bills. A Personal Injury Lawyer makes sure the insurance companies cover the entire expense. He or she sees that the injured person gets the proper compensation. The best thing about engaging a Personal Injury Lawyer is that they charge the least amount of money. There are also cases where the injured person makes unrealistic claims worth millions of dollars. In such cases the Personal Injury Lawyer will advise what the victim can actually claim. Usually an Injury Attorney will use their experience to negotiate an out of court settlement with the insurance companies and people at fault. An out of court settlement is always better than an in court settlement as one cannot be too sure of the judgment and also it helps in reducing unnecessary court costs.

Victims will come across a good Personal Injury Lawyer by doing a bit of research online. There are many websites and blogs which are dedicated to such causes. Usually these sites provide a list of most renowned lawyers who charge a minimal percentage and make sure justice is served.

Article on What to Expect When You are Expecting a Divorce, a New York City Divorce Lawyer Provides Valuable Free Information

(PRWEB) December 5, 2004

This article explains what you should know and do before going for a divorce consultation with a New York State Divorce Lawyer.

When you feel at the pit of your stomach, that something is terribly wrong in your relationship with your spouse, and what you are experiencing is a nagging, recurrent problem rather than a rough patch that all couples go through, then what you are feeling may mean one of two things:

1. That you are ready to learn about your rights and obligations as a spouse. Such that you can become more of an equal partner in the ongoing, ever changing and vital, relationship we call marriage; or

2. That you are ready to break away from a destructive relationship and secure a separation or dissolution of your marriage.

We are imbedded in a culture that tells us that finding love and marriage will be the attainment of our greatest success in life. We are taught very early on that somehow we will “fall in love’ and live happily ever after. From the advertisements we see on television, to the books we are forced to read in elementary school, we are lead to believe that something is wrong if we are not married. Even the finest artwork of the Masters, displayed in museums throughout the world, depicts love and the institution of marriage as a panacea for all of our problems that it is a romantic escapade that will, somehow rope in the light at the end an abysmal day. Renoir, for instance, was particularly devoted to the subject of lovers and often as an abstract impressionist unknowingly capitalized on the frailties and weaknesses of lovers. In “The Boating Party Lunch”, this work has an obscure brightness to it that glorified romantic love and made his paintings great. Renoir was an abstract impressionist, not a realist, and as such the beauty of his work arose from the fact that he, Renoir, rarely sought out the substance of what he saw, but only the superficial appearance of things.

So no wonder people feel ashamed, even mortified when their marriage has failed and they are forced to appear tail between their legs. Into the office of a stranger, the loathed “New York State Divorce Lawyer”, left with the option of divorce, the abysmal antithesis to the notion of perfect love. The parties are left with no in between, place where they can redefine themselves and their spouses. Especially if there are children involved.

Life sometimes imitates art. Enter Jackson Pollock, the antithesis of Renoir, an abstract expressionist who saw ugliness in convention, he rebelled against it. He defied all conventions and imparted beauty through acts of defiance rage and alcoholism. Wholly disregarding and disrespecting the institution of marriage, he lived as he had died, meeting his gruesome death as a married man, wrapped around the wheel of a car and seated with him, not his wife, but his lover, Ruth Gligman. So what lesson does life impart upon us? Is the romantic reverie of marriage the panacea of the human condition, as Renoir would have us believe, or must drunken love and betrayal leave weeping widows (or widowers) behind who would have been far happier divorced. The answer is not at all clear, but we are closer to the truth when we identify marriage as what it really isŠa lifetime partnership, romantic or otherwise, that will only work under the regular principles of a business relationship.

Business partners have responsibilities. Business partners know that, hurting each other is hurtful to the business. Business partners know that a partnership will fail if both partners are not thriving. A marriage then is a partnership of sorts, equally complicated by the reality of romantic love. By taking concrete steps to assume more responsibility for yourself in the marriage you will feel less helpless, more empowered and ultimately less dependent upon your spouse to provide for your financial, emotional, physical and psychological needs. These are things that are not taught to us in school, or growing up at home. By learning about your rights and obligations you will become less dependent upon your spouse, and that will tend to lessen the feeling of entrapment that the enfranchised spouse always has when the unemployed spouse is leaning to heavily upon that partner for financial and psychological support. Thus, knowing what a marriage entails, and not the Hollywood version, should be an integral part of saving you marriage. Seeing a New York State Divorce Lawyer might in fact save your marriage rather than end it.

But, what if both parties have realized that all love is lost, then what? The parties appear helpless, alone and infuriated. They feel like they have failed in their ultimate role as perfect husband or perfect wife. Again, not a good enough reason to get divorced, but perhaps a good enough reason to seek a marriage counselor or a psychologist, a consultation with your priest or rabbi, a serious talk with family and friends. When you have exhausted all measures to make it right, and you still feel “disconnected’ from your spouse and that feeling is not just a fleeting whim but rather an ongoing weight, then at this stage it’s time to start thinking about seeing a divorce lawyer.

The Caveat to this is that if you are a victim of domestic violence, you should call the police FIRST and secure a safe haven for you and the children. Then retain a competent New York divorce lawyer.

I firmly believe that the New York State divorce lawyer of your choice has a genuine interest in helping you. I know this from my eighteen years of practicing in this area of law. However, in many ways you can make it easier for that divorce lawyer. Have your documents in order, and when you see your New York State Divorce Attorney come prepared.

New York City Personal Injury Lisa Beth Older Offers General Information on What to Expect when Seeking Personal Injury Litigation in New York State

New York, NY (PRWEB) July 20, 2006

Lisa Beth Older offers free consumer advice on personal injury law.

“I am now a New York personal injury lawyer, a NYC personal injury attorney willing to work hard with a reputable law firm and team of attorneys and support staff that has the time and resources to litigate your case to the best possible result,” she said. “My team deals with people with serious physical injuries or suffering over the loss of a loved one through wrongful death.”

People often ask Older what to look for in a personal injury lawyer in New York.

“I learned everything I know by studying under the best New York personal injury lawyers and by taking CLE Courses that keep me up to date on the several changes in the personal injury law in New York,” Older said. “The lawyers I have worked with in the past have a unique combination of compassion for the aggrieved client, an ability to articulate the case to the Court and to the adversary professional knowledge of the field of personal injury, and most importantly the ability to listen and learn from their clients.”

She offers the following advice to potential litigants in the Empire State.

The New York personal injury lawyer you would want to retain should speak with you free of charge to see if you have a case. They can not guarantee a result, nor can they take every case as they are guided by New York State laws governing serious physical injury. If you do not have a serious physical injury that meets the legal threshold a New York personal injury lawyer should not take your case and make false promises. The NYC personal injury lawyer you choose to represent you on your case should be available to answer your questions during all stages of the litigation. They should promise that they will be available to fight vigorously in the prosecution of your case.

There is no obligation to hire a personal injury lawyer in New York, but you may speak to one, usually free of charge. Their fee is usually a contingency basis but some will charge costs. Rest assured, as with any lawyer, everything you say or impart upon your case is confidential.

You may discharge an attorney at any time, although, if you recover on your case ultimately your first lawyer is entitled to be compensated for the work he performed, so the second lawyer will want to obtain a release from the first lawyer or a statement as to the amount of money that lawyer believes he or she is entitled to receive in the event of a personal injury monetary recovery. Under the retainer agreement you sign which is itself governed by New York State Law, the second attorney will l have to pay to pay that first lawyer for their time spent on your case. That is why it is especially important to choose a personal injury lawyer you can trust and stick with throughout the case as it becomes difficult and sometimes complicated to find a new personal injury lawyer in New York to take over you case once they discover or ascertain that the first lawyer has significant time into your case and thus a potential financial interest in the recovery.

You may often hear the word “tort” in a personal injury lawyers’ office. Torts are recognized by law as grounds for a personal injury lawsuit. These wrongs usually result in an physical injury or harm constituting the basis for a claim by the injured party.

While some torts are also crimes punishable with imprisonment, the primary aim of tort law, from a personal injury lawyers’ perspective is to provide monetary relief for damages wrongfully or negligently inflicted, and the other aim is to secure the expectancy that others in society will act carefully and thus prevent harm to others.

An injured person may also go to an attorney to sue for an injunction to prevent the continuation of wrongful conduct that leads to injury.

Among the types of damages the injured party may recover are: loss of earnings capacity, pain and suffering, and reasonable medical expenses. They include both present and future expected losses.

I just got a misdemeanor hit and run on a parked car, what should I expect?

Question by Marco: I just got a misdemeanor hit and run on a parked car, what should I expect?
I didn’t know I commited hit and run when the actual event happened. I was at a packed mall with no parking spots, then I tried to park in a space that was too small and I got on the curb so I backed out (I didn’t noticed I hit anything.) My friends who were infront of the parking spot noticed the whole thing, they honestly didn’t even noticed I hit a curb, let alone hit a car.

It wasn’t till I left and my friend told me I might have hit a car and after that I noticed a scratch on my car. After that I rubbed the couple of scratches out with my bare hands. I just learned after I gave my statement to the police that my friend said he saw some woman who wasn’t even the owner of the car go crazy when I did I backed out of the spot and rubbed up against another car and she got my license while I was driving away (because I didn’t drive away like a madman because I didn’t think I did hit and run.)

The officer said he got me on security cam and said I tried to back out like a madman but I told him my friend was infront of me and when I was backing out I hit the curb and said “oh shit” I tried backing out all retarded on the curb (I assume this is when it happened) then a car behind me got on my right up on my backside (because he was probably trying to park in my spot because it was crowded) and I started honking at him. The officer comfirmed I satyed there in that spot for a while after I hit the other car.

Anyways I did noticed later that I had hit a car but between the time of the incident and the time the cop went to my house it was like within 1 hour to 90 minutes. I had a prior permanent scratch in the same area the officer said I hit the car, and when he came he was gun ho that I did it and he wanted me to confess to things I was uncertain about or else he would take me to jail. At first I wasn’t honest about me rubing out the scratch but after he put me in his car and admited to the whole thing honestly and he still didn’t accept it. He wanted me to say I knew I hit the car and that’s why I backed out like a madman or else he would take me to jail. So I told him what he wanted to hear, but that the part about knowing I hit the car at that moment was a lie, its not what happened it’s just what he wanted me to say. I also exagerated how much I cleaned up the scratches because he didn’t except I did with my hand. I said I cleaned it with a rag at my friends house, which is a lie. At one point I told him I felt he was entraping me because I told him everything and he was still threatening me that I was going to jail unless I told him “the truth.”

I was able to rub off my damage, the officer showed me the other car, it looked like paint damage to me but he said something about chipping off some piece of plastic on the bumber (and paint damage.) It was a mercedez benz he told me (it was big though in the picture, I think maybe it’s a SUV but I don’t know.)

I admit I noticed later I had hit a car and I had some time to go back and inform the driver so I admit to hit and run but I don’t like the way the officer treated me the whole time. Like I said I had to lie about how it happened just so he wouldn’t take me to jail.

He gave me a misdemeanor hit and run (california). It’s vehicle code 20002(a) hit and run. The other vehicle’s damage is seriously paint but the officer said some bumber piece fell off.

So knowing this info here are my questions to you.

1. Should I get a court appointed attourney, or represent myself? I’m not getting a lawyer because I know most DUI lawyers are theives and don’t really help you out.

2. I’m trying to get into law enforement (not as a cop), so how bad does this affect me in the application process?

3. I have a spotless record, so what’s the chances I might g
Just to clarify if I were to get a PA it would probably be a cheap specialist, hence why I said DUI lawyer.

You never want to try and handle a case yourself. Do you honestly think you know the law better than a Prosecutor who has been to law school? Obviously not. You’ll want an attorney. I’d recommend getting a public defender as this is a pretty straight forward case and PD’s are quite good at handling these types of cases. Don’t waste your money on a private attorney.

Make sure you keep in touch with your friends in case they have to testify for you.

You won’t go to jail. You’ll probably get your license suspended, have to pay restitution for the damage to the vehicle, and probation at most. This is a very low level misdemeanor and is going to take place is misd. traffic court.

Let your attorney handle the ins and outs of the law, as well as how it can be handled.

Good luck.

Q&A: What kind of settlement should we expect from an auto accident?

Question by butterfliangie: What kind of settlement should we expect from an auto accident?
Me and my fiance were involved in an auto accident where the other driver was completely at fault. This accident happened over 2 1/2 years ago. I was pregnant at the time and my fiance had to have surgery and 6 months of therapy to rebuild his shoulder. We lost all of our income for 7 months. His medical bills and lost wages exceeded 100 thousand $ . Now we are trying to settle and the insurance company offered to pay the medical bills, lost wages plus 5,000 dollars “pain and suffering” We are not trying to be greedy here but it seems like nothing compared to what was messed up by the accident. Our lawyer seems so non chalant about it. My fiance asked about the 3x the medical bills for pain and suffering and our lawyer told him it was a myth and not to expect more than what the ins. com. offered the 1st time. Does this seem fair…I’m seriously considering getting a 2nd opinion from a different lawyer…anybody been through the same kind of thing…what was the end result? Thanks!
We are not trying to make a “profit” off of it…but I had to basically be a caregiver to a grown man for 3 months while I was 7 -9 months pregnant…His doctors say he has permanent disability in his right arm/shoulder that could definitly cause probs later in life (we were only 23 when it happened) Not to mention we were financially set until this happened and when my daughter was born we had to borrow money just to buy the nessicitiys needed for her.
Our attorney isn’t offering any advice and the policy limit is $ 500,000 per person so $ 5,000 did seem silly to me
No…it doesn’t include lost earning potential

Your not supposed to be making a profit off of it. Why should the insurance company give you anymore?

Does anyone know what to expect when an appeal goes to “Mediation”?

Question by Ella: Does anyone know what to expect when an appeal goes to “Mediation”?
Our Home Owners Association is launching an appeal on rental increases. Our lawyer (after spending all our money, told us we should find another lawyer who knows more about lawsuits?) Duh!? So we lost the first round now we have an appeal that is going into “mediation”. What should our side expect when we get there?
It is a Manufactured Home Park. You own the home but rent the land.

Best answer:

Answer by MLaw
The same thing as any trial mediation. The mediator will seek to have the parties come to a settlement agreement. Most of the session will be spend “in caucus,” wherein the two sides will be in separate rooms & the mediator will attempt to broker a settlement by going back & forth. The advantage of mediation is that anything you tell the mediator is confidential so both sides can be frank with him/her & s/he can try to find some mutual grounds of agreement.
