Q&A: Don’t trust this man. FUNNY or NOT?

Question by bon-bon: Don’t trust this man. FUNNY or NOT?
A man was chosen for jury duty who really wanted to be dismissed from serving. He tried every excuse he could think of but none of them worked.
On the day of the trial, he decided to give it one more shot. As the trial was about to begin, he asked if he could approach the bench.

“Your Honor,” he said, “I must be excused from this trial because I am prejudiced against the defendant. I took one look at the man in the blue suit with those beady eyes and that dishonest face and I said ‘He’s a crook! He’s guilty!’ So, your Honor, I cannot possibly stay on this jury!”

With a tired annoyance the judge replied, “Get back in the jury box, you fool. That man is the defendant’s lawyer.”

Don’t Hire the Wrong Third Party Work Injury Lawyer: 10 Important Questions

Some States, such as California, have the lowest workers compensation benefits in the United States. These States have workers compensation laws that are very unfair to seriously injured workers and their families.

Because of this, for most seriously injured workers, the only way they are going to receive fair compensation for their work injury case is by successfully bringing a third party work injury case. If you get injured at work, you can not sue your employer. Generally, the only recovery you have against your employer is workers compensation benefits.

If someone else is legally responsible for your injuries you can bring a third party civil lawsuit. Also called a third party case. With a third party case you can recover lost wages, pain and suffering, and loss of enjoyment of life damages. You can not recover these damages in a workers compensation case. This is why if you are a seriously injured worker you must try and hire the right work injury attorney for your case.

A word to the wise. The great thing about the Internet is also the problem with the Internet. The Internet allows just about anybody to say just about anything. Anyone can call themselves a “Third Party Work Injury Attorney” or the like. They can do this whether they have been handling these cases for 20 years or they hope you’ll sign up with them so they can handle their first real third party work injury case. Fact is, it is difficult for the average client to tell the difference.

Here are some questions for the third party work injury lawyer you may consider hiring for your serious work injury case:

1. How many third party cases has the lawyer successfully handled?

2. Has the lawyer received favorable results at trial for third party work injury cases?

3. Does the lawyer or the lawyer’s firm handle workers compensation cases?

4. Has the attorney published articles in the area of third party work injuries? Have they published third party work injury articles in prestigious lawyer publications?

5. Has the lawyer been recognized by their peers? For example, have they been elected to office by the local Trial Lawyer / Consumer Lawyer organizations? Have they been elected to office by their state-wide Trial Lawyer / Consumer Lawyer organizations?

6. Has the lawyer been involved in important State Supreme Court cases?

7. Does the attorney have testimonials from other workers for their work injury cases?

8. Does the lawyer project confidence when you speak to them about your case?

9. What is the lawyers AVVO rating?

10. Does the lawyer have an informative website regarding work injuries?

Be sure to take the time to research and evaluate the third party work injury attorney you hire. We understand that not every seriously injured worker will be able to hire the very best work injury lawyer for their third party case. But if you ask these questions, you will be in a much better position to evaluate the lawyers ability to successfully handle your work injury case.

Disclaimer:

This article is not legal advice. I am simplistic in order to achieve clarity. The circumstances of your case may vary from those described herein. The foregoing legal discussion is based upon California work injury law. The law in your State may vary. If you are a seriously injured worker you should consult with a third party work injury lawyer.

Answer by DJP
1. I am a Criminal Defense Attorney. My Primary practice is as a “Bar Advocate”, a private attorney who accepts Court Appointed criminal cases in the District Courts of Massachusetts on behalf of indigent individuals. In Massachusetts, the term “Public Defender” is applied to a state employee attorney representing the indigent, usually in Superior Court.

2. No childhood experience, but I have been guided by my high school motto “I serve”

3. I find that this field allows me to “cause trouble” and help people.

4. I originally intended to have a Military career, but started doing Law and liked it. I entered the law at age 35.

5. I studied law at New England School of Law in Boston, MA. It is an independent law school (not affiliated with a University).

6. I have an undergrad degree in Political Science.

7. I start the day in my office at 8:00, assembling files to go to Court for 9:00 – I will frequently be there until 4:00 or later and then return to the office for an additional hour or more to interview clients and keep up with paperwork. On days I am not in court, I will frequently be out of the office investigating and interviewing witnesses. Nights are often devoted to research and writing.

8. A undergrad degree is required to enter law school (4 years of college) and law school itself is either three years (full time student) or four years (Part-time at night)

9. My first case was collecting money for a plumber for work he had done.

10. The most frustrating, grinding, pain-in-the-butt job you will ever love. The clients are both the most frustrating and the most interersting people you will ever meet.

11. I am paid $ 50.00 per hour for the work I do as a “Bar Advocate”. Out of that I pay all the costs of running my office and what ever is left is taxed and I get what is left after the taxman. (I am a “solo practicioner” not in a firm.)

12. Hm mm, advice?? a) When someone tells you that you have a right to remain silent, pay attention and take that advice. b) never park by a fire hydrant 😉

Question by Shaylee: Im so different and I dont know how to escape.?
Im 15. And…im so different from everyone else in my school. I mean, everyone…is the same. They all know what they want to do and most of them include being a doctor, lawyer, business, or just in that general area. I..I dont know. I hate the idea of “what do you want to do when you grow up”. Bc there is SO MUCH. I want to explore. I want to create something. I want to be..unforgettable. Cheesy, sorry. But there is so much I want to do…photography, acting, producing,writing..but where I live…I cant. I live in this itty bitty town…and there is NOTHING. Everyone is the same and Im like…the exotic different girl. I want to..get out. Bc I feel like Im trapped and Im never going to get anywhere. I just saw the movie inception..and I know its not real…but I wish it were. I mean…it was so…amazing. And the film itself was..breathtaking. I want to produce or write something like that. Help?

Answer by Not Imposter Abdul
If you want to produce or write something like that, be like me and go into filmmaking. Take drama classes, screenwriting. (Namely in college.)

Keep your options wide, and your enemies wider. You never what you may want to do, or what adventure you may inadvertently find yourself in after a series of wacky hi-jinks ensue in the first act!
