After a Deadly Accident, Both Vehicle Drivers Claim to be in the Right



New York, NY (PRWEB) November 5, 2009

An East Village crash has caught the attention of New York personal injury lawyers all around the city including expert New York auto accident attorney, David Perecman.

According to the New York Post, very early Saturday morning, the passenger of a minivan was killed in a vehicle accident in the East Village, New York. Personal injury lawyers would not find this particularly unusual, except that both drivers are insistently claiming to have had the green light.

The passenger, Jacqueline Franklin, 55, was a resident of Queens. The minivan she was riding in collided with a cargo van.

Emergency personnel ripped the roof off the minivan to rescue Franklin, but she was dead.

No charges have been filed against either driver. However, New York personal injury lawyers predict a complicated court case could be looming. Families of victims often seek compensation for their loss. It is unknown if any video footage exists of the vehicle accident.

Hello,

I hope today find you all doing well.

Background:
I filed for the divorce, so I’m the Plaintiff in a divorce. I don’t have an attorney, as i could afford one.
The Defendant does have an attorney.

My question:
My question is Can her attorney hold me liable for her fee? (I know the answer is yes/no but what does #25 mean in “plain english”)

Her attorney put the following statement in the Judgment of Divorce:

20. ATTORNEY FEES/ATTORNEY’S LIEN — IT IS FURTHER ORDERED AND ADJUDGED that each party shall be responsible for and pay his or her own attorney fees. IT IS FURTHER ORDERED AND ADJUDGED that the law firm of Her Lawyer, shall have an attorney’s lien against Defendant’s proceeds of this settlement to the extent of costs and attorney fees incurred in this matter.

25. REAL AND PERSONAL PROPERTY. IT IS FURTHER ORDERED AND ADJUDGED that the following liens have been imposed by operation of law: the law firm of HER Lawyer, shall have an attorney’s lien against Plaintiff’s proceeds of this settlement to the extent of costs and attorney fees incurred in this matter.

What do you Think?
To me, the non lawyer, #20 means “we pay our own way”

However, also to me, #25 means “I might end up with some of her lawyer fee liens against me too”

Seeing how i was laid off 6 months ago, I can’t afford her lawyer’s fees.

Thanks for any help which you may lend.

the judge most likely ordered the attorney to represent both of you and will sign off on the judgement which allows a lien on your share of the marital asset.

This is the reason why YOU should have an attorney!! The other atty. is eating up your interest

How much longer do I have to wait to get divorced after mediation takes place and we both agree on everything?

Question by pbanker: How much longer do I have to wait to get divorced after mediation takes place and we both agree on everything?
I hired a lawyer to get divorced and he told me it would be 90 days because there is a house and a baby involved. She didn’t hire a lawyer because she couldn’t afford one at the time. Day 88 in this 90 day period she decides to hire a lawyer so this extended everything. Now we recently were suposed to meet for mediation and her lawyer called in sick and canceled mediation, crazy I know. Well now there is a NEW date set , a NEW date for mediation.

Question is When we finally go to mediation do we get divorced that day IF we agree on everything or how much longer do I have to wait to get my divorce decree?
Please give me all the advice I can get and hints in details, I have some explaining to do to a new special someone and would like to keep her up to date and not look lost and stupid in front of her sounding like “I DON’T KNOW”

if both of u agree for divorce on mutual consent basis,after 1yr waiting period of filing application, u are given a date…it usually should be over on that day itself if there are no complications from either sides!!!
