Q&A: Immigration and bankruptcy? How will it play out?

Question by MaRi: Immigration and bankruptcy? How will it play out?
My husband is in the US as a permanent resident. In January we will be doing an “adjustment of status” so he has his green card for 10 yrs. I am looking into filing bankruptcy; yes I know its a god awful thing, but I have to do what I have to do. We live in Arizona. Does anyone know if this will affect his immigration status? I have done some research but find that yes it will, or no it wont.
Anyone with any experience; possibly? Direct links?
I am going to talk to my immigration lawyer, but she is out on vacation for a week, and I have an appointment with the bankruptcy lawyer this week!
Any help will do and GREATLY appreciated.

Thank you in advance.

Answer by Yak Rider
We did away with debtor’s prison several hundred years ago. Nobody at USCIS is going to care about your/his bankruptcy. However, the bankruptcy does not cancel the affidavit of support. That will continue to be enforceable.

Person really has to suffer a lot in terms of bad credit report, person’s both personal and professional life gets badly disturbed by taking this decision. Apart from this, filing for bankruptcy has many other disadvantages. One of the advantages is that this method is very costly and person really has to bear the high charges of legal lawyers and attorneys. The process of bankruptcy is very long time taking and complicated and person really has to go through many procedures in order to declare him as bankrupted.

While on the other hand, the process of debt settlement is easy. In order to get complete benefit of this method it is advisable that person should hire the services of professional debt Settlement Company. Many skilled and trained experts’ work with these companies and due to these financial experts person is capable of getting elimination in outstanding amount conveniently. Best thing about debt settlement is that, it is not very time taking or complicated process and every person can easily go for it. Besides this, the process of settlement is also not very expensive and the companies charge very nominal fees that is easily affordable by each and every individual. Apart from many advantages, the process of settlement has also a drawback and that is; it creates negative impact on person’s credit report but the effect will not stay for many years like in the case of bankruptcy and as soon as person pay backs the amount the bad impact from credit reports move away.

Since debt settlement has more benefits as compared to drawbacks; that is why it is good for the person to select for settlement deals, in order to get quick relief from the burden of all bad debts.

The use of credit card is increasing day by day. But the wrong usage of these credit cards is turning people to the financial crisis. Many people have to face the problems of huge debt. This situation of debt is increasing the financial economic pressure. For The people who cannot pay back the borrowed money, the U.S.A Government has made some new and simple laws. People are worried and afraid to face such problems of liabilities. Therefore, the Federal Government has made it easier and due to a little awareness, people are making their financial lives easy and better.

A debt settlement company is a plate for those persons who can’t pay back the debt amounts and are facing financial problems. Mostly people, who do not know about such facilities, turn automatically to bankruptcy. Actually, they don’t know the side effects of bankruptcy. But debt settlement has removed such problems. People are hiring them and solving their financial problems in an easy and affordable way. Many people were choosing bankruptcy for their relief. Due to the increasing ratio of bankruptcy, the Government made some new laws so that people can easily avail a simple way for getting relief from liabilities.

Some important and basic points of this law are to observe the financial status of that person who is filling for bankruptcy. These laws are for those people who have a lot of income and they can maintain their status in economy. According to the new law, the people who have solved their solutions by a settlement or negotiation company can’t file for bankruptcy. Due to these new laws, bankruptcy has become much expensive solution for debt relief. Now it contains high cost like when a person files for bankruptcy, he has to hire an attorney for his help to fight against the lender. This is not an easy way to solve the financial problems of any person. A legal lawyer always charges a high fee from his the costumer for handling the case of bankruptcy.

That’s why it is always recommended to choose a settlement or negotiation company instead of bankruptcy.

If you have over ,000 in unsecured debt it may be a wise financial decision to consider a debt settlement. Due to the recession and overwhelming amount of people in debt, creditors are having no choice but to agree to debt settlement deals. If you are in serious debt and you are thinking to file for bankruptcy, then it is advisable that you should think twice before you actually implement it. Though bankruptcy brings fast reduction in the amount of your dues but at the same time it damages your credit scoring. Due to this bad impact, you will get ineligible of availing any facility of bank for the next several years. The process of bankruptcy is also expensive as the legal lawyers charge huge amount of fees in return of their services. Filing bankruptcy is also not good from creditor’s aspect as well. If any of their customers declare them as bankrupt then they are not able to recover their money. In a nutshell, it is correct to say that filing bankruptcy is more like an emotional way for the elimination of the debts rather than a sensible one. The best relief tactic to avoid bankruptcy is debt settlement.

The concept of debt settlement came into being after the skyrocketing increase in the cases of bankruptcy. If the accumulated amount of your debts is near about ten thousand dollars then it is advisable that you should take the help of settlement companies at the first place. Financial experts of these companies will negotiate with your lender and make them aware about your bad financial conditions. With the help of their expert advices, you will be able to get 50% to 70 % decline in your outstanding balances easily. Debt settlement brings negative impacts on your credit rating but this impact is only for a short period of time and once you clear all your dues, the negative impact will move out easily. The Financial settlement procedure is inexpensive and it does not create burden on your pocket as well. Creditors are also happy with the settlement deal as in this way they are able to get back their money without facing any difficulty.

The process is gaining much more public interest after the changes done by the federal trade commission in the preexisting laws of the settlement. The new laws are providing more safety and security to you. It is always suggestible to go for the other alternatives rather than making the wrong decision of filing for bankruptcy.

If you have over ,000 in unsecured debt it may be a wise financial decision to consider a debt settlement. Due to the recession and overwhelming amount of people in debt, creditors are having no choice but to agree to debt settlement deals.
