Question by vincentpjimenez: Should I wait after my probation ends before my immigration lawyer can file my papers for a spousal petition?
My lawyers says i need to wait after my informal probation ends, then they can file the petition for me (I-130, I-485). I got married to my wife who is a US citizen and I was convicted of shoplifting on Jan 8, 2008. the 2 year informal probation ends on Jan 8, 2010, and my lawyer says that we should file the papers after Jan 8, 2010. Why are they delaying this? What problems might arise if I file the petition asap? I know there is a “petty offense exception” law and my case falls under this because it is a single offense, the maximum possible jail time was 6 months only, and I did not do actual jail time. Please advise I don’t want to waste money anymore. I have made a lot of consultations with different lawyers around 12 maybe and all of them say that its not a problem as long as its a single petty offense, and we just have to sign a waiver. But when I actually hired a lawyer, this lawyer all of a sudden told me to wait after my probation before they can file my papers to the INS. I will not be able to work for 1 year because I dont have a work permit, and my papers will definitely be delayed. I am thinking of getting another lawyer who is more specialized in this area and firing my current lawyer. My current lawyer says they can file it right now, but i will have to sign a waiver that if the outcome is bad (deportation) that they will not be responsible for it, because the lawyer can lose his license. Please advise.
I am here legally up until Jan 1, 2009, when my H-4 visa expired. I got arrested on Oct 25, 2007 while I was still in status.

After a Deadly Accident, Both Vehicle Drivers Claim to be in the Right



New York, NY (PRWEB) November 5, 2009

An East Village crash has caught the attention of New York personal injury lawyers all around the city including expert New York auto accident attorney, David Perecman.

What happens with my position and seniority at work after 2 years of workers comp?

I have been in workers comp for 2 years now in Illinois. I have permanent restrictions (25%, cannot walk more than 3 hours), and my lawyer is trying to settle (He won’t tell me how much in average for the leg, or if there is life medical, nothing). What happens with my position at work? I cannot perform the same job anymore plus I do not have personal medical insurance anymore. I was working for some other companies, since I am a freelance. Now I am loosing all the other jobs, insurance, position, seniority in these places too. My lawyer says is “immaterial”, he cannot do anything about it. The place where I had the accident is supposed to guarantee the job for life?

your settlement is based on set guidelines from the state using your % of total disability.
then since you can not return to your old employment these factors are used to determine a multiplier, your age, skills that transfer to another job, education and work history, this multiplier can be as much as 6 times the dollar amount that is determined by the % of total disability.
usually the settlement will include continuing medical coverage but that coverage is for the original injury NOT for other medical conditions. you must use the same doctors as you have for the WC injury and must be pre-approved for any doctor visits .

your attorney is correct about these other jobs being irrelevant
all WC deals with is your work related injury and the permanent partial disability that resulted from it.
there is not much for an attorney to do, the settlement must be within the states guidelines and the state must approve the settlement.

the employer does NOT guarantee your job for life. if you can not perform the essential duties of the job then you can’t, and therefor you will no longer be employed.
