The California personal injury lawyers of BISNAR | CHASE (http://www.BestAttorney.com ) have filed a products liability injury lawsuit against Pepsico, Inc., The Pepsi Bottling Group, Inc., Metal Container Corporation and New Albertson’s, Inc. The suit alleges that a Diet Pepsi can exploded in the hand of Lynda Ryan, causing the opening tab at the top of the can to break loose and fly at a high rate of speed into Ms. Ryan’s left eye, causing catastrophic damage to her eye resulting in essentially 100 percent vision loss. The action was brought against the aforementioned defendants by the plaintiff, Lynda Ryan.

Alleged Defective Pepsi Product Causes Severe Personal Injury

According to court records, Lynda Ryan purchased a 12-pack of Diet Pepsi from Albertson’s retail outlet in Blythe, California, several days before July 9, 2008 and placed the cans of soda in an ice chest in the back of her vehicle. Over the next few days, the plaintiff consumed most of the beverages without incident and without any indication there was a problem with the cans. On July 9, 2008, Lynda removed one of the three or four remaining cans of soda and, with a normal movement that did not involve excessive shaking or any other act that would cause the carbonated beverage inside to become excessively stimulated, she began to lift the pull tab to open the can. Before this movement was completed, however, the can exploded, causing the piece of the top which usually opens downward and stays attached to the can to instead break off and fly into Lynda’s left eye, causing traumatic eye injuries and resulting in essentially 100 percent loss of vision.

“We’re alleging that Pepsico, Inc., The Pepsi Bottling Group, Inc., Metal Container Corporation and New Albertson’s, Inc. knew or should have known there were inherent vices and defects in the design and manufacturing of Pepsi’s containers,” said Brian Chase, California personal injury lawyer and partner at BISNAR | CHASE. “We allege that, in order to save money, the defendants used thinner and thinner thicknesses of the metal used to make the cans and top until it reached the point that the metal would unexpectedly break under normal pressure and usage by consumers, thereby putting profits over the safety of its customers.”    

Chase further alleges that each of the defendants in this case breached their duty of care by placing into the stream of commerce a defective and unsafe product for the use in which it was intended — a product that was dangerous to Ms. Ryan as well as consumers who would use it in a normal fashion.

Plaintiff Suffers Extreme Pain, Extensive Medical Procedures

As a result of this incident, Lynda Ryan suffered severe globe rupture, extensive corneal laceration, lens destruction, corectopia traumatic cataract, uveal prolapse, vitreous prolapse and corneoscleral rupture resulting in essentially 100 percent vision loss in her left eye. Lynda has undergone, and will continue to undergo, extensive necessary medical diagnosis and treatment procedures. What’s more, Ms. Ryan has suffered, and will continue to suffer, severe pain and mental suffering. “It’s not presently known whether the loss of Ms. Ryan’s vision will be permanent in whole or in part, and this will not be known until all necessary medical procedures have been substantially completed,” said Chase.

The action seeks economic damages for the catastrophic injuries sustained by Lynda Ryan, including ongoing medical costs and loss of income due to her injuries, and damages for her permanent pain, suffering, disfigurement and mental anguish. The lawsuit is pending in the Superior Court of California, County of Los Angeles, case # YC058827.

Question by conerned mom of a 8 year old: what leagal action can I take to get rid of my “mother in law”. my guy husband and I live like roomates.
My husband and I married in 1995 in China. Then we came to USA to study. the marriage has not been a good one, it turned out years later, he is guy. We decide we will live like roomates for the sake of our 7 year old son, and have an open marriage. until 2 month ago, his mother moved in with us with the understanding that she is going to help with our son because my husband is doing extensive traveling and he is rarely home, not mention help with our son. the mother in law can’t drive, can’t speak English. and she is getting very upset seeing my boy friend help me picking up my son to school. so She wants to ban my boy friend from entering the house, she refues to help with anything in the house. and of course, my guy husband is on her side, and saying that he has the right to have her mother staying in the house. we have been arguing every time we see each other and I want both of them out. I want to know my rights, does anyone know any good divorce lawyers?

i’m a little confused. did you think your husband was a woman? ok. the good news is, you can just leave…leave her alone in the house. whatever. pick a day. move everything into storage and move into an apt. if necessary.

i don’t think it is a good environment for your son for you to have a bf.

“If you’ve ever dealt with the government, you know there’s one thing they don’t lack: an overabundance of red tape,” says Nikki Mehrpoo Jacobson, an immigration attorney and Chair of the Immigration Law Committee at the Beverly Hills Bar Association, who will be one of the lawyers lobbying Congress for immigration reform at the National American Immigration Lawyers Association event in Washington, DC this March.

The American Immigration Lawyers Association (AILA) is holding a national “Day of Action” on March 25, 2010 to highlight the need for immigration reform in the United States. Immigration Lawyer Nikki Mehrpoo Jacobson and other immigration attorneys hope to spend the day educating government officials about the practical challenges presented by current immigration regulations and the need for a streamlined and more efficient system.

Through AILA’s “Day of Action,” it is hoped that government officials will seriously reflect on the strengths and weaknesses of immigration law and will examine the areas in which immigration reform would be beneficial. When asked about the importance of this event, Nikki Mehrpoo Jacobson, Esq., stated, “This day is an important day not just for politicians, but for all Americans. As one of the experienced immigration lawyers lobbying Congress, my goal is to let our elected officials understand how their legislation negatively affects, not only hardworking immigrants, but also U.S. Citizens.” Mehrpoo Jacobson also stressed that immigration reform could even save American families money by reducing the number of bureaucratic hoops they are forced to jump though again and again, from lost paperwork to an unnecessarily long waiting period.

The AILA National Day of Action will begin on March 25, 2010 with registration from 7:00-9:15 am at the Marriott Metro Center Hotel in Washington, D.C. From 9:00 am to 5:00 pm, there will be opportunities for conference attendees to interact with elected Congressional officials and Congressional staff. The closing reception will begin at 6:00 pm and will end at 8:00 pm at the National AILA Office on 1331 G Street NW in Washington, DC.

Nikki Mehrpoo Jacobson is a very motivated and enthusiastic Immigration Law Lawyer who teaches people how to successfully navigate the ins and outs of the American legal system.
