Texas case is one of two being used to define how far punishments of immigrants can go

WASHINGTON – Possession of a small amount of cocaine is a misdemeanor under federal law. But in Texas, the crime is a felony — serious enough that it helped send Reymundo Toledo-Flores to prison for two years before he was deported to Mexico.

On Tuesday, the first day of arguments in the U.S. Supreme Court’s 2006-07 term, the justices will consider Toledo-Flores’ criminal case, along with that of a fellow Mexican national deported after a similar drug conviction in South Dakota. The issue before the court is whether the federal or the state view of the immigrants’ crimes should be used to decide their prison sentences and the terms of their deportation proceedings.

To decide, the justices will need to clarify a federal immigration law that once was aimed at ridding the country of foreigners convicted of crimes such as rape and murder but increasingly is being used by immigration authorities to deport those charged with relatively minor offenses, including drug possession and shoplifting.

“The idea was that when immigrants commit really serious crimes, we didn’t want them in the country,” said Magali Candler, a Houston lawyer who chairs the regional chapter of the American Immigration Lawyers Association. “But over the years, the immigration laws have been amended repeatedly and now they are written so broadly that an immigrant who commits a minor crime, even if they never served a day in jail, can be deported.”

Court records show that Toledo-Flores has repeatedly entered the United States illegally. He was deported last spring after serving his two-year sentence for felony illegal re-entry — a prison term that was lengthened because of his previous conviction in Harris County for possessing less than a gram of cocaine.

His lawyers are challenging his enhanced sentence before the Supreme Court, saying that because the drug possession charge would not be a felony under federal law, it should not have been used to increase Toledo-Flores’ sentence on the re-entry conviction. If he wins, Toledo-Flores would gain nothing, but his case could help other immigrants charged with similar crimes fight their sentences and deportations.

In october, i saw that my dad was on basically an internet dating site.i found that he was talking to other women and everything. i told my mom and long story short, after a long time of crying, my dad agreed to work on the marriage.

then my mom came to me saying she found emails talking about an affair he had with someone in Brazil when he went there on a “business trip”. one invited a girl over to our house during the day, one saying “i wish we can be together in two years”
my mom found emails dating back to 2005 and now she is talking to a divorce lawyer.she wants my dad to move out and to get a divorce
i am only 16 and my mom confides in me all the time about what to do.

part of me wants the divorce and part doesnt
with all of this, i hate my dad right now and if a divorce happens, i don’t want to live with my dad. what are the chances of my mom having sole custody? she makes enough money to support me i just want to know the legal aspect of it

just advice on how to deal?

If Arizona’s immigration law is not about race, then why is it that Canadians can come across much easier and stay longer than Mexicans?

To come legally, A Canadian can simply use a modified drivers license to come across the border. There is no need for a visa, there is no waiting period, there is no deep background check and no disclosure about where you will be. Furthermore, the Canadian can stay indefinitely, have children here, anchor themselves here, and become US citizens. (my neighbor did this, she is from Canada)
Canadians need very little extra documentation to work here and make money. Many Canadians are even offered special social security cards for work.

To come legally, A Mexican must be put on a multi-year long waiting list just to APPLY for a visa. Then they have to wait years to get approved. They have to disclose everyone they know, how much they make, and how much their family makes. They have to pay thousands of dollars to the US government to apply. They need immigration lawyers professionals. They then can only stay a maximum of 6 months, but normally they are only granted 2-4 weeks. They are never offered any means of work and are expected to leave immediately.

So, if “the law is the law” and “what part of illegal don’t you understand” is so true, then why is it that it is so much easier for white Canadians to be legal and follow the law, but so much more incredibly difficult for brown Mexicans?

Why is the definition of “legal” different for Canadians as it is for Mexicans?

Are we just simply making up the rules of what is “legal” based on color?

Aren’t we simply labeling people as “illegal” based on what we define as “illegal” and not on a consistent set of values or laws?

Are we designing laws simply to keep certain ethnic groups out of our country, and only allowing those who we want?

Why do people think that the playing field is equal for all immigrants, and that Mexicans should just come here legally, like everyone else, when the rules against them are so much more impenetrable than it is for Canadians?
Dina W: You didn’t realize it because it doesn’t exist. We make it easier for them to come and give them social security numbers. IF they come here illegally, we simply modify the system to make them legal, thus there is no Canadian illegal immigration problem.

It is real easy to follow the law when the law is easy to follow. It is hard to follow the law if the law is written to keep you oppressed.
Maxwell: As I told Dina, They do not abuse the system because the system CATERS to their needs. It is real easy not to abuse the system when they are allowed to be part of it from day one.

If we (meaning the law) treated Canadians like Mexicans, there would be more illegal Canadians than Mexicans.

Canadians obey laws. Mexicans do not. You respect us, we respect you. Mexicans have no respect for our country or its laws. If they did, they would come here legally.
