Question by need advice: Married H1,got H4,divorced,become out of status,married U.S permanent resident ,how to apply for residency?
I came to the U.S. on H4 visa after getting married ,my marriage include lot of abuse and ends in divorce.I am out of status since then,approx.5 years, I married my present husband, who become permaent residence an year after our marriage ,it`s three years now,I have two kids with him,he is applying for his citizenship next year, I wish to apply for a Permament Resident Visa, what paperwork must I file? what forms should I file? should I seek legal assistance for being Out-Of-Status? Is there a different procedure, form, fee, fine, for being out of status? if there is, does it matter how long have I been out-of-status? the longer i have been out of status, the greater the fine, fee, etc.? What are some “normal, regular” lawyer fees for this kind of case? Please help if you are an immigration lawyer, and actually know what you are talking about. Or if you just recently wnet through the same situation, and know exactly what to do! thank you!

Get a lawyer, you are going to need one. I think, I am not a lawyer, that there is a fee for being out-of-status. My consultant told me it was $ 1,000. Talk to a professional.
